Terms & Conditions 1. Identification - All purchasers are required to have a Bidder's Number to bid and shall supply Platinum Auctions with their full name, address and telephone number. A form of picture identification is required to verify information. 2. Addition to or withdrawal from sale - The Auctioneer reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed before calling for bids, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all of the items listed in bulk. 3. Item Condition - All property is sold "AS IS" with all faults. 4. Inspection - It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determining factor before bidding. 5. Condition of items sold - The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. 6. Dispute between bidders - If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. 7. Auctioneers bidder - will be the high bidder, auction team/handlers cannot accept a bid on behalf of the auctioneer. 8. Auction Help - Auction help has the right to bid on any and all item's. 9. Any announcement made the day of auction shall take precedence over any previously printed material or any other oral statements made. 10. Handlers Bidder- Handlers cannot accept bids. Handlers can acknowledge a bid and make the auctioneer aware of bidder's intent to bid. 11. SOLD - Once auctioneer says sold, Item(s) become property of the bidder/buyer. 12. Securing Property - It is the buyers responsibility to secure item(s) once auctioneer says sold. Platinum Auctions is not responsible for Loss, Damaged, or Stolen item(s) 13. Making Payment - All items are to be paid in full on auction day. Methods of payment: Check, Credit/Debit Card and Cash. (any fee associated with payment will pass on to the buyer) 3% fee for master card and visa, 10% fee for American express. 14. Item Removal- All purchased items are to be removed from auction site the day of auction. 15. Buyers Premium- The Bidder acknowledges and agrees that a 10% buyer's premium will be added to the hammer price on all individual lots sold. 16. Sales Tax - Wisconsin 5.5% sale tax will be collected on all vehicles. It will be added on top of hammer price and buyer's premium. Sales tax Exemption- if buyers have a tax license "Wisconsin Resale Certificate" 17. Absolute Auction Law - UCC 2-328. Sale by Auction. (1) In a sale by auction if goods are put up in lots each lot is the subject of a separate sale.(2) A sale by auction is complete when the auctioneer so announces by the fall of the hammer or in other customary manner. Where a bid is made while the hammer is falling in acceptance of a prior bid the auctioneer may in his discretion reopen the bidding or declare the goods sold under the bid on which the hammer was falling.(3) Such a sale is with reserve unless the goods are in explicit terms put up without reserve. In an auction with reserve the auctioneer may withdraw the goods at any time until he announces completion of the sale. In an auction without reserve, after the auctioneer calls for bids on an article or lot, that article or lot cannot be withdrawn unless no bid is made within a reasonable time. In either case a bidder may retract his bid until the auctioneer's announcement of completion of the sale, but a bidder's retraction does not revive any previous bid.(4) If the auctioneer knowingly receives a bid on the seller's behalf or the seller makes or procures such a bid, and notice has not been given that liberty for such bidding is reserved, the buyer may at his option avoid the sale or take the goods at the price of the last good faith bid prior to the completion of the sale. This subsection shall not apply to any bid at a forced sale. Auction Jargon As is Selling the property without warranties as to the condition and/or the fitness of the property for a particular use. Buyers are solely responsible for examining and judging the property for their own protection. Otherwise known as "As Is, Where Is" and "In its Present Condition." Bidder's Choice A method of sale whereby the successful high bidder wins the right to choose an asset or assets from a grouping of similar or like-kind assets. After the high bidder's selection, the asset is deleted from the group, and the second round of bidding commences, with the high bidder in round two choosing an asset, which is then deleted from the group and so on, until all assets are sold. Also known as "Buyer's Choice." Buyer's Premium An advertised percentage of the high bid or flat fee added to the high bid to determine the total contract price to be paid by the buyer. Hammer Price Price established by the highest bidder and acknowledged by the auctioneer before dropping the hammer or gavel. Absentee Bid A procedure that allows a bidder to participate in the bidding process without being physically present. Generally, a bidder submits an offer on an item prior to the auction. Absentee bids are usually handled under an established set of guidelines by the auctioneer or auction company. The particular rules and procedures of absentee bids are unique to each auction company. Bid A prospective buyer's indication or offer of a price they are willing to pay to purchase property at auction. Bids are usually in standardized increments established by the auctioneer.
