BRAND X INC. PUBLIC AUCTION TERMS AND CONDITIONS BUYER: Any registered bidder is considered the buyer. LOT: A lot is the item being offered for sale. AUCTIONEER: IS BRAND X INC. A licensed Nevada used vehicle dealer. REGISTRATION: The auctioneer requires bidders, to register before bidding on items; bidders must be at least 18 years of age and have valid identification. All documentation will be issued under the name and address listed at time of registration, no changes will be made after lots are sold. PAYMENT: Buyers purchases are to be paid in full by close of auction or the following business day. TYPES OF PAYMENT: Cash, cashier's checks, bank wire transfer, credit card, visa , master card, American express; checks are accepted upon approval of brand x inc. Prior to sale. FEES: All lots are assessed a 12% buyers premium, that will be added to the total cost of each lot purchased. 3% will be added to lots purchased with credit card. A $68 title processing fee will be assessed on all lots with tittles. A $48 applicable smog fee will be charged on all units that have been smogged. 7.1%Sales tax will be collected on all lots unless proper exemptions are on file at time of registration. WARRANTIES: All lots are being sold in AS IS WHERE IS CONDITION WITH NO WARRANTIES WHETHER EXPRESSED OR IMPLIED AND ALL SALES ARE FINAL. DEALERS: A copy of dealer's license and applicable sales tax exemption is required for all dealers who register prior to bidding BUY IT NOW: All lots are subject to prior sale or being pulled from auction at auctioneer's discretion, please be careful to check before traveling BIDDER RESPONSIBILITIES: By bidding on lots you are accepting these and other terms: Bidder agrees to be responsible for the payment of the purchase price of all lots purchased under their bidder number. No lot or form of payment including credit card payment can be canceled or rejected for any reason whatsoever by buyer. Bidders are responsible for closely checking each lot he/she is bidding on. The bidder understands that he/she is buying the property entirely upon his or her own opinion. Any information or description of lots sold is provided as a courtesy only and is believed to be accurate but is not guaranteed. The auctioneer strongly suggests that all vehicles should be previewed by a prospective buyer on the arranged preview days. Announcements made by the auctioneer on the day of sale take precedence over any printed or verbal material pertaining to this auction. EMISSION EXEMPTION NOTICE: Brand X Inc. is exempt from providing emissions testing or inspections for motor vehicles pursuant to regulations adopted under NRS 445B.770 for motor vehicles sold at a consignment auction. Buyers who reside in an area where emissions testing or inspections are required will be responsible for obtaining their own emissions certificates prior to registering the vehicle. Any repairs necessary to bring the vehicle purchased into compliance is also the responsibility of the buyer. DOCUMENTATION: Tittles will be sent only after full payment has been receive and all units have been paid in full by buyer, no drive away placards will be issued on auction day. REMOVAL/PICK UP: Lots can only be removed from the auctioneers property or location with a paid in full receipt. If lots are not removed by 5:00 of the fifth business day after auction a $25 daily storage fee per lot will be charged. Unless other arrangements have been made. THE AUCTIONEER IS NOT RESPONSIBLE FOR LOSS, THEFT OR DAMAGE TO ANY LOTS SOLD INCLUDING THE LOSS OF KEYS.
