Terms: $5,000 deposit on day of sale with cash or certified funds payable to Morris James, LLC, the balance to be paid within 21 days following the auction date, with cash or certified funds payable to Morris James, LLC. Prospective bidders must present the initial deposit in cash or certified funds at the time of registration. Trustee shall prepare and deliver the deed. Purchaser and Seller shall split the Delaware 2 1/2% State Realty Transfer Tax and the 1 1/2% Kent County Realty Transfer Tax. Purchaser shall pay any and all other closing costs, property transfer tax and fees. If the above terms are not complied with, the down payment shall be forfeited. This property is being sold As Is and Where Is with no expressed or implied warranty. Buyers are solely responsible for their own due diligence. Announcements made the day of sale take precedence over any printed material. Sale is subject to confirmation by the Court of Chancery of the State of Delaware. Trustee shall make a return of sale within 30 days following the date of sale. Absent an objection to confirmation, the sale will be deemed confirmed without further Order by the Court after fourteen (14) days following the Trustee’s Return of Sale.

NOTICE TO CREDITORS: Any person or entity having or claiming any lien or encumbrance against the estate, or interest of any of the parties entitled to the shares in the premises to be sold, must present their claim to the Trustee or file same with The Court of Chancery of The State of Delaware, within 14 days following the Trustee’s Return of Sale, or such claim will be deemed to have been abandoned.
