It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor by the title and descriptive information along with the photographs provided. Bounds Auctions has endeavored to fully and completely describe the merchandise in its text and photographs and warrants that each photo represents the actual item offered. All photography was performed on site, in available natural lighting. Every attempt has been made to properly represent the merchandise. In no event shall Bounds Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value and condition. Auction and all documentation is in English only; all communication with auction company must be in English. Parking will be in the front lot, along Mermaid Lane, or in the Laurel Beech Park lot; ABSOLUTELY NO PARKING IN THE REAR OF ROBERTSON'S SPECIAL NOTE Growing stock: Auctioneer is also an American Orchid Society Senior Judge and has touched every plant in the offering. No insect infested plants were found. No warranty is implied and no testing done. Plant conditions vary greatly from stressed, to excellent. Most require repotting. Plants without identification are noted as "NDL". Plants have identification unless noted as "NDL" Plants are offered in large lots. ALL UNSOLD GROWING STOCK WILL BE DESTROYED IMMEDIATELY AFTER SALE. Condition statements are as follows: Fine. The best condition expected. Good: Plant is generally healthy, growing, minor imperfections, likely needs to be repotted. Fair: In need of repotting ASAP, requires time to grow on into shape. Poor: Plant is at risk, will need skilled care. When bids are made, sales are final and no returns are accepted for any reason other than receiving the wrong item. Should an item be damaged in shipping, the buyer will have purchased insurance to cover said loss and collect from the carrier's insurance directly. Under no circumstances will the Bidder hold Bounds Auctions or any of its agents responsible for any problem created by the internet auction service provider. BUYER'S PREMIUM: 13% Buyer's Premium with finance fees included is charged on the total. By registering to bid, Buyer agrees to pay the buyer's premium and all related packing and shipping costs. Bounds Auctions will make every reasonable effort to respond to all emails or phone calls on a timely basis (i.e. within 24 hours). We advise that you register to bid in the auction as soon as possible. We cannot guarantee that bidders registering the day the auction ends will be approved. DETERMINATION OF HIGHEST BIDDER: The highest bidder accepted by the auctioneer shall be the buyer. In the event of any dispute the auctioneer may determine who the successful bidder is and his decision shall be final. Your bid is a legally binding contract. Upon the fall of the auctioneer's hammer, title will pass to the highest bidder, and the property is thereafter at the purchaser's sole risk and responsibility. Participants must register and be approved to bid before the auction. The auctioneer reserves the right to deny approval for any reason. PAYMENT Payment is due at the close of the auction, upon presentation of the invoice to the buyer via e-mail. PayPal is our preferred method of payment and is made available directly through the invoice. Visa and MasterCard are also accepted. Wire transfer is recommend for any bidder's total in excess of $5,000 USD, and required by all bidders outside the United Sates, with the buyer bearing all costs associated with sending the transfer. PA sales tax will NOT be charged to PA residents, under PA Statute 32.4, Isolated sales by an executor of an estate. CREDIT CARDS If not using Paypal, the Auction Company accepts Visa and MasterCard ONLY for payment (remember - you can pay with a credit card at PayPal). Winning bidder's credit card information will be required by the electronic bidding platform to register to bid. Courier Service is also available upon advance request. Please wait for initial contact from the shipping agent, which will happen once the merchandise has transferred to their possession. Shipping and packing and insurance (if desired) costs are paid directly to the shipping agent. It is strongly preferred that all merchandise be handled by the exclusive shipper for this auction. The shipper will receive items upon receipt of payment to Bounds Auctions. Arrangements for packing, shipping, etc. and all costs associated with same will be between buyer and shipping agent. Shipping agent will contact buyer when merchandise moves into their possession. Lots will be combined for shipping to minimize cost as much as possible. Lots to be shipped will be prepped, delivered to our shipping agent and they will contact the buyer for payment directly for packing and shipping by carrier of your choice. SPECIAL NOTE: There is a $5.00 per lot handling charge, maximum of 5 lots ( $25 maximum charge per bidder, no additional charge after 5 lots) on growing stock to be shipped. This covers the costs of preparation of the lot for packing. Most plants will be de -potted and made bare root, while others only have their pots wrapped. The auction company is not responsible for any moving, packing or shipping. PICK - UP: Thursday Nov 16th, Saturday Nov 18th and Sunday Nov 19th: You must provide your copy of the paid invoice and identification at time of pick up. Please keep in mind that the majority of these items are kept in a secure environment, therefore advance notice must be given and pick up will be at a location subject to the approval of Bounds Auctions. You will need to provide all of the necessary packing materials, and all labor to move your items. Without exception, abandoned lots will be forfeit if left post pick up date, unless other arraignments are made with auctioneer.
