LOCATION:  From the intersection of Highway 15 and 136 at Fairbury, NE, go about ½ mile East and turn right to 712 Road and go 2 miles East to the Northwest corner of the farm.  Or from Jansen, NE, take 573 Ave. South 2 & ½ miles to Road 712 Road, then go 2 miles West to the Northwest corner of the farm.

 

LEGAL DESCRIPTION:  The Northwest Quarter (NW ¼) of Section Seventeen (17), Township Two North (T2N), Range Three East (R3E) of the 6th P.M., Jefferson County, Nebraska.

 

GENERAL DESCRIPTION:  This is a productive, slightly rolling irrigated farm consisting of 160 acres per the assessor.  The farm is approximately 1.2 percent Crete silt loam, 0 to 1 percent slopes, 20.6 acres Crete silt loam, 1 to 3 percent slopes, 66.9 percent Crete silty clay loam, 3 to 7 percent slopes, eroded, 3.3 percent Morrill clay loam, 3 to 6 percent slopes, eroded, and 8 percent Nodaway silt loam, occasionally flooded.  The FSA records show the farm has 153.5 acres of cropland.  Base acres, PLC Yields and HIP are as follows:

IRRIGATION INFORMATION:  The irrigation well was drilled in 1967, is 800 GPM, with a static level of 103 ft. and a pumping level of 108 ft.  The column diameter is 8 inches and the well depth is 175 ft.  There is a Reinke 8 tower center pivot with drops, a 2010 John Deere 4045HF285 4 cylinder power unit on a chassis and with a canopy.  All irrigation equipment, including the fuel tank shall stay with the property.

 

MINERAL & WATER RIGHTS:  Any mineral and water rights owned by the Seller will transfer to the Buyer.

 

INSPECTION:  The farm is open for inspection any time.  Please have respected for the tenant’s crops.

 

POSSESSION: Landlord’s possession shall be granted upon closing.  Buyer shall receive Seller’s share of the crops which is 36% and subject to the management fee of 8%.  The tenant pays all input costs.  Full possession shall be given March 1, 2018.

 

TAXES:  Seller shall be responsible for 2016 and all prior year’s taxes.  Buyer to be responsible for the 2017 taxes.  The 2016 taxes were $10,610.72 with the exemption.

 

MANNER OF SALE:  The farm will be sold by dollars per acre times 160 acres.

 

TERMS:  A non-refundable earnest money deposit equal to 20% of the purchase price shall be paid the day of the auction upon signing the purchase agreement.  The balance shall be paid on closing which will be on or before June 9, 2017 in the form of certified funds.  Title insurance and the escrow closing fee shall be shared equally between the Buyer and Seller.  Any lender’s policy or required endorsements shall be the expense of the Buyer.  Abstract & Title, Inc. shall be the title insurance company.  Schultis & Son, Inc. will conduct the escrow closing.  The farm is not being sold contingent on loan approval.  Make all financial arrangements prior to the auction and be prepared to buy.  The property is sold in “AS IS” condition with no survey, warranties, inspections, repairs, or treatments provided or paid for by the Seller or Real Estate company.  Schultis & Son, Inc. are agents of and represent the Seller in this transaction.   Any announcements made the day of the auction take precedence over printed or oral information provided.  Sale is subject to 24 hour confirmation by the Sellers.
