Kirkwood, Esq, the undersigned substitute trustee, will offer for sale at public auction at the front entrance of the Circuit Court for the County of Chesterfield, Virginia located at 9500 Courthouse Rd, Chesterfield, VA 23832 on the 7th day of December, 2020 at 11:00 AM, the property described in said deed of trust, located at the above address and briefly described as:

The property will be sold in “AS IS, WHERE IS” condition, without recourse. The property is subject to the rights of the occupants, if any. The property is sold to the purchaser subject to all superior conditions, easements, liens, covenants, assessments, any law suits at law or equity, restrictions of record, agreements of record. The property is also sold to the purchaser subject to the right of redemption periods for any IRS and Department of Justice liens, if applicable. Neither the trustees, nor the noteholder, nor their respective agents, successors, and assigns make any representations or warranties, expressed or implied, with respect to the property or the improvements located thereon, or any tenancies or parties in possession. Purchaser shall be responsible for obtaining physical possession of the property.

TERMS OF SALE: ALL CASH. By bidding, a prospective purchaser agrees to the terms and conditions as advertised and announced by the auctioneer. A bidder’s deposit of $10,000 or ten percent (10%) of the sale price, whichever is lesser, will be required in the form of a certified or cashier’s check. Settlement within fifteen (15) days, otherwise deposit may be forfeited. Time is of the essence. The risk of loss from casualty or otherwise, as well as all liabilities of the ownership of the property, shall pass to the purchaser at the conclusion of the bidding. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are prorated to the date of sale. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. Without forfeiting the deposit, the trustee may avail itself of any legal or equitable means against the defaulting Purchaser. If the trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest, plus $1.00. This sale is subject to post-sale audit of the status of the loan secured by the deed of trust, including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be subject to cancellation and purchaser’s sole remedy shall be return of deposit without interest, plus $1.00.
