General Terms & Conditions For Personal Property

All bidders are required to register and give full identification and establish credit with Auction Company prior to the beginning of the auction. Register early to ensure your approval for bidding by auction time. Note: To supply your credit information by telephone rather than online, please call 304-258-BIDS
Auction Company reserves the right to refuse admittance to any person(s). No transfer will be recognized from one bidder/buyer to another.
All items, whether personal property or real estate, are sold “As Is, Where Is”, with no warranties or guarantees, express or implied, made by the Seller, Auctioneer or Auction Company.
All sales are final.
You expressly agree that the use of this Website is at your sole risk, responsibility and obligation. J Lawyer Auctions LLC or its members, employees or providers warrant that this Site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this site, or as to the accuracy, completeness, reliability, security, or currency of the Site.
By bidding on an item, the bidder shows acceptance of the terms of the auction and acceptance of the item(s) being bid on.
No bidder shall retract their bid. Online bidding during a live auction is a fast process, and as a result, there may be no confirmation given – bids will be taken immediately and are irrevocable.
A 13% Buyer’s Premium will be added to each item sold. Please refer to the specific terms of each auction on the website information for the buyer’s premium percentage. (Example: A 13% buyer’s premium added to a $100 high bid on an item equals a total purchase price for bidder of $113).
Catalog and/or website descriptions of items or properties are for identification purposes only; no representation is made to the correctness, authenticity, age, origin or value of the item(s). Bidders must do the necessary ‘due diligence’ on the item(s) or property prior to the auction and rely solely on their own judgment when bidding.
Any and all announcements or changes made by the Auctioneer on the day of the auction supersede any prior marketing materials.
If bidder breaches or defaults any portion of the terms & conditions of auction, bidder agrees to pay any and all charges and expenses incurred by Auction Company, including, without limitation, reasonable attorney’s fees, and deficiencies and re-marketing expenses resulting from resale of the item(s) or property. Additional commission shall be due and payable.
Please note when bidding, there is an auto-extend feature on this online auction system. If someone bids in the last 2 minutes immediately prior to the end of the auction on that item, the online auction system will automatically extend the bidding time for a 2-4 minute increment (and will continue to do so) until that period(after the original closing time) where no one bids, then the auction on that item will close. This feature will leave the bidding open for any item that has received a bid within the last 2 minutes from the last recorded bid time, even if the ending time has been reached. This feature has been added to eliminate sniping and to make the online bidding process more fair and resemble a 'live' auction.

Additional Terms For Personal Property
Bidders are responsible for all removal, shipping and damage costs incurred with their items purchased. We ask you bring plenty of help and appropriate equipment for removal of your items.
In the event the buyer fails to pay for the entire purchase within the time set forth by the Auction Company, and/or fails to comply with any of the conditions or terms of sale:
the seller may retain and/or recover any monies paid as part of damages;
items that are not paid for can be resold at public or private sale without further notice;
any deficiency resulting from such resale shall be due to the Auction Company by the defaulting buyer together with all charges, fees and expenses, including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder.
Should a dispute arise after the auction, Auction Company records shall be conclusive in all respects. In an unresolved dispute case, the item(s) may be re-offered for auction; however, Auctioneer, in their sole discretion, will analyze the good faith of the parties involved and make the final determination as to the final disposition of the item(s). Auctioneer’s decision is final.

Burnside's Bridge Pewter Sculpture by Chilmark, #636 of 1500
Burnside's Bridge Pewter Sculpture by Chilmark. A Chilmark pewter statue by Francis Barnhum is a limited edition piece that is huge measuring at 24 inches x 12 inches x 9.5 inches tall. Burnside's Bridge is a landmark on the Antietam National Battlefield near Sharpsburg, Maryland. Crossing over Antietam Creek, the bridge played a key role in the September 1862 Battle of Antietam during the American Civil War when a small number of Confederate soldiers from Georgia for several hours held off repeated attempts by elements of the Union Army to take the bridge by force. Finally, the Federals seized it, but not before the attack had been delayed for several hours beyond what had been expected by Maj. Gen. Ambrose Burnside. The bridge now bears Burnside's name. Constructed in 1836 of area limestone and granite by local Dunker farmers, the three-arched, 12-foot (3.7 m)-wide, 125-foot (38 m)-long bridge provided a passageway over Antietam Creek for farmers to take their produce and livestock to market in Sharpsburg. It was originally named the Lower Bridge, as there were two others (Upper Bridge and Middle Bridge) upstream that also allowed movement of freight, animals, and people across the creek. The Lower Bridge took on the name Rohrbach's Bridge after a farmer, Henry Rohrbach, who lived near the structure. After the war, the U.S. Government acquired the bridge and adjoining land. Vehicular traffic across the bridge was stopped and the original farm lanes allowed to grow over with grass. Foot traffic is still allowed across the structure, which remains as one of the most photographed bridges of the Civil War. Estimated less than 50 yrs old. Pewter is a malleable metal alloy, traditionally 85 to 99 percent tin, with the remainder consisting of copper, antimony, bismuth and sometimes, less commonly today, lead. Silver is also sometimes used. Copper and antimony act as hardeners while lead is common in the lower grades of pewter, which have a bluish tint. It has a low melting point, around 338 to 446 deg F, depending on the exact mixture of metals. Final bid is subject to seller approval.

CHILMARK FINE PEWTER, 1998 CIVIL WAR "FIRE ZOUAVES" sculpted by FRANCIS J. BARNUM. Nowhere was the bravado of the Zouaves more distinguished than on the sloping Sharpsburg grade that fronted Antietam, the place where the 9th NY Regiment, the Fire Zouaves, withstood killing fire, but refused to be dislodged from an obviously indefensible position.

In the event the buyer fails to pay for the entire purchase within the time set forth by the Auction Company, and/or fails to comply with any of the conditions or terms of sale:
the seller may retain and/or recover any monies paid as part of damages;
items that are not paid for can be resold at public or private sale without further notice;
any deficiency resulting from such resale shall be due to the Auction Company by the defaulting buyer together with all charges, fees and expenses, including reasonable attorney fees incurred by such resale and enforcement of the obligation hereunder.

Listing Terms and Conditions

In the event the buyer fails to pay for the entire purchase within the time set forth by the Auction Company, and/or fails to comply with any of the conditions or terms of sale:
