Tri County Auction Online Auctions SPECIAL INSTRUCTIONS: You must provide your own help for packing and moving as none will be available. TERMS AND CONDITIONS: Payment: There is a 13% Buyers Premium charged for each item (lot) with a 3% discount for cash, money order or Cashier’s check. Accepted forms of payment are cash, money order, cashier’s check, MasterCard and Visa. Any total over $500 dollars will require payment to be by certified funds, cash or credit card. Payment will be collected at the time of pickup. After the end of the auction you will receive an invoice by email. Buyers Premium, Sales tax and Surtax (if applicable) will be applied to the Bid Total. If you are tax exempt please bring a copy of your tax exempt certificate with you or sales tax will be charged. Please note if you have bid on items at auction and you do not receive an email you are responsible to inquire as to whether or not you are the winning bidder. (Please note it is possible to see whether you have won by reviewing your bids at the end of the auction.) None receipt of an email does not exclude you from your responsibility to pay for your items. If payment is not received by the end of the scheduled pick up date and time Tri County Auction will still hold you responsible for payment of the items and fees incurred. If you fail to contact us to make payment by the end of the scheduled pick up date and time WE WILL turn off your bidding privileges, your items will be forfeited and YOU WILL still be responsible for full payment of all items and fees. SALES TAX: Buyers are required to pay sales tax and Surtax (if applicable) unless exempted by law. Buyers that are exempt must provide a signed copy of their tax exemption in order for an exemption to be made. Sales tax is 7%. BUYERS PREMIUM: There is a 13% Buyers Premium added to all winning bids with a 3% discount for cash, money orders and Cashier’s checks. FORMS OF PAYMENT: Tri County Auctions accepts the following forms of payment: cash, money order, Cashier’s check, Visa and MasterCard PICK UP: Terms for pick up are as follows NO EXCEPTIONS: All items must be picked up at the place, day and time designated on the email sent at the end of the auction. It is also listed in the auction listing. If you should have a question as to the location, date or time please contact Tri County Auction at 941-769-2347. Anyone who does not pick up items at the designated time WILL BE charged a $10.00 or 15% of purchase whichever is greater. If payment is not received by the end of the scheduled pick up date and time Tri County Auction will still hold you responsible for payment of the items and fees incurred. If you fail to contact us to make payment by the end of the scheduled pick up date and time WE WILL turn off your bidding privileges, your items will be forfeited and YOU WILL still be responsible for full payment of all items and fee. Bidders are responsible for their own removal. Any item NOT picked up by the set time will be considered abandoned. NO refunds or charge backs will be granted due to lack of removal at designated times. Removal shall be at the expense, liability, and risk of the buyer. Purchases will be released upon payment. Please insure that movers or anyone picking up items on your behalf have your paid receipt with them or payment and your invoice with them. No item will be released for pickup without being paid for. Remember to bring sufficient help and packing supplies with you. NOTE: If an item is not available for pickup the buyer must notify Tri County Auction staff on site at time of pickup noting the item on your original emailed invoice that is not available for pickup. At the end of pickup if a claim has not been made Tri County Auction, the Auctioneer and the Buyer agree that no adjustment or refund will be made. It is the buyer’s responsibility to make sure that they have all their items prior to leaving pickup site. Tri County Auction and the Auctioneer will not be held responsible for lost and/or missing items at the close of designated pickup. BIDDING: When placing a bid please be aware: review your bid before you hit the final submit button. We cannot reverse bids that have been submitted. Bid and choose wisely. Tri County Auction would like everyone to get a good deal. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. “You bid, You buy”. When in doubt about the condition, completeness or suitability for intended use, please bid accordingly. To review the bids you submitted use the “review bids” feature at the bottom of the page next to where you log in. ITEM CLOSING: Our online auction features staggered closing with two items closing every minute. The closing time is automatically extended an additional five minutes whenever a bid is placed within the last five minutes. BIDDING NOTIFICATIONS: You will receive an email letting you know that you have been outbid on an item up until midnight of the last day before the auction ends. At the end of the auction you will receive an email containing your invoice for the items you won. CATALOG INACCURACIES: Please review the item description. You are bidding on the description not the photo. On rare occasion a photo could be attached to the wrong description. Remember items may be joined together for demonstration purposes. Do not assume a lot consists of more than one item simply because they are connected and/or pictured together. Please read the lot descriptions carefully. CONDITIONS OF SALE: All items are sold “AS IS, WHERE IS” with all faults. There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. Tri County Auction and the Auctioneer do not warrant the accuracy, genuineness, authenticity, condition, description, weight, count or measure of any of the lots specified herein. We recommend that you make a personal examination of the objects for which you wish to place a bid on whenever possible. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to the authenticity, age, condition, materials and/or any other feature of items being sold. Tri County Auction tries to catalog every item correctly and will attempt to point out any defects or flaws but will not be responsible or liable for the correctness of the catalog or other descriptions of the item. By placing a bid you are agreeing that you have examined the items you wish to bid on or that you have chosen not to examine them. IMPORTANT: If any and all applicable conditions herein are not complied with by the buyer, Tri County Auction at its option my either cancel the sale, resell the property on a future auction without reserve or minimum selling price, and the buyer will be liable and agrees to pay for any and all deficiencies and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, legal, collection; transportation and storage expenses and all other charges due hereunder and incidental damages associated with delinquent accounts or abandoned items. Tri County Auction reserves the right to add and/or remove items from the auction, make changes to the auction closing times, preview times or pick up times; split or combine lots, add minimum bids or reserve prices and cancel, suspend, extend or reschedule an individual item and/or auction. Tri County Auction reserves the right to reject any bid not commensurate with the value of the property offered. Tri County Auction reserves the right to reject and/or refuse any payment type from buyers. Tri County Auction also reserves the right to cancel, suspend or block any person/buyer and/or person/buyer’s account for any reason it deems appropriate without notice to the person/buyer. A range of estimates may be given on an item and/or lot with either a low and/or high estimate. Estimates are simply an opinion and not a reliable prediction of the actual selling price. Tri County Auction makes no warranties related to them. Any disagreement/controversy or claim arising out of or relating to this contract and/or agreement or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Sarasota County Florida. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.
