Auction Terms & Conditions - REGISTRATION & BID NUMBER ACCEPTANCE: By registering and accepting a bid number online, the bidder acknowledges they have read, understand, and agrees to be bound by the terms and conditions of Auction posted online in this document or available at auction site. When you sign up for a bidder number your credit card number will be retained and charged for your purchase(s), unless previous arrangements with management are made prior to auction day. By clicking the accept button online, you enter into a binding legal agreement with Auction Sales Co., LLC. Auction Sales Co., LLC is providing Internet online bidding as a service to Bidder. Bidder acknowledges and understands that internet service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Auction Sales Co., LLC or anyone else if their Internet service fails to work correctly before or during the auction. Internet bidders who desire to make certain their bid is acknowledged should use the Pre bidding feature and leave their maximum bid prior to the auction closing. Registered bidders are responsible and liable for all bids they place - intentional or accidental. Lots will have a "STAGGERED" and "SOFT CLOSE". You will be notified by email that you are the winning bidder. Email invoices will be sent as soon as the Auction closes. What is a "STAGGERED CLOSE"? The lots do not close all at the same time. Lots will have a staggered closing using a mixed sequence. Follow the clock to the right of each lot to know the exact closing time of a particular lot. What is a "SOFT CLOSE"?? If a bid is submitted and confirmed during the last 2 minutes before closing, then the time will be extended on that lot by 1 minute. This will continue until no more bids are placed on the lot. GENERAL TERMS OF AUCTION: It is the bidder's responsibility to preview and inspect the items prior to bidding/buying and determine the condition of the item they are bidding on. All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as announced by the auctioneer at time of auction. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. It is important that the buyer avail themselves of the inspection periods. All items sold "AS IS" meaning the bidder is responsible for due diligence in inspecting all items. Auction Sales Co., LLC will pass on any information, good or bad, that the seller provides when describing the items. Auction Sales Co., LLC is not responsible for incorrect listing information. However, it is up to buyer to determine the condition of the item they are bidding on. All sales are final. When a bidder is awarded the winning bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item. AUCTION SALES CO., LLC RESERVES THE RIGHT TO WITHDRAW, CHANGE OR RE-CATALOG ITEMS IN THIS AUCTION. ALL MEASUREMENTS ARE APPROXIMATE. By bidding you are acknowledging agreement with all of the terms and conditions included herein and else where on our website. The highest Bidder shall be the Buyer and no Bidder shall retract their bid. A Buyer is deemed to have accepted an item or lot when they make their bid. A successful bid at auction constitutes a legally binding contract of sale. All sales are final. The acceptable bidding increments are established and controlled by the Auctioneer. Any dispute arising as to any bidding shall be settled by Auctioneer at his sole discretion, and Auctioneer may put the lot in dispute up for sale again. Auctioneer reserves the right to refuse any bid, which it considers to be an insignificant advance over the preceding bid. Certain items in the sale are being offered subject to reserve, which is the confidential minimum price below which such lot will not be sold. The Auctioneer has the right to place a bid for the consignor up to the Lot's reserve. Lots that fail to meet the reserve price may be represented for sale in another auction. Auction Sales Co, LLC reserves the right to allow any and all employees to bid. Seller and/or Auctioneer reserve the right to reject a Bidders registration application and/or bids for any reason in their sole discretion without prior contact to the Bidder. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. PAYMENT: Your credit/debit card number will be retained for this sale only, and charged for your purchase(s) at the close of the auction, unless prior payment arrangements have been made with Auction Sales Co., LLC staff prior to the close of the auction (auctionsalesco@gmail.com) An additional 3% processing fee will be charged for any card used. We accept: Visa, Mastercard, American Express and Discover. Purchases cannot be removed from the auction site until paid for in full. If paid for with non-certified funds, items will not be released until funds clear our bank. Payment in full is due prior to pickup. Auction Sales Co., LLC accepts cash, credit/debit cards, wire transfers and cashiers checks. BUYERS PREMIUM: Premium will be added to EACH LOT purchased at the following rate: Items selling up to $5,000.00 - 10% Items selling from $5,001.00 to $10,000.00 - 5% Items selling from $10,001.00 and above - 2.5% REMOVAL OF ITEMS/SHIPPING & HOLD HARMLESS: The buyer is solely responsible for removal and shipping of their own purchases. Items may be picked up by appointment only. Forklifts and forklift drivers will be on site to ASSIST in loadout if necessary. The buyer is soley responsible for verifying all items they have purchased have been loaded. Auction Sales Co. and their employee's are not liable for any item left behind by the buyer. All items must be picked up by the dates listed in this auction's details. ANY ITEM(S) NOT PICKED UP OR PAID FOR BY THE DATES LISTED IN THIS AUCTION'S DETAILS, WITHOUT PRIOR ARRANGEMENTS BEING MADE WITH MANAGEMENT OF AUCTION SALES CO, LLC, WILL BE DEEMED ABANDONED AND WILL BECOME THE PROPERTY OF AUCTION SALES CO. Successful bidders will be required to schedule an appointment for their load out. Successful bidders will be sent an email with their invoice which will include a link to sign up for a load out date and time. PURCHASER SHALL MAKE HIS OWN ARRANGEMENTS FOR INSURANCE COVERAGE FOR ALL ITEMS PURCHASED. The purchaser hereby agrees to indemnify and hold harmless Auction Sales Co., LLC, their employee's and the seller, against any and all liability, loss, costs, damages and other expenses arising from attending and purchasing at the auction or the loading out of purchased items and equipment by Auction Sales Co., LLC on the purchaser's behalf. All lots must be removed within the stated load out schedule. Any item not picked up or paid for by during these dates will be deemed abandoned and will become the property of Auction Sales Co., LLC. Items will be removed at purchaser's sole cost and risk, and only in a manner approved by auctioneer. Prior to the commencement of loading, dismantling, rigging or cutting or any operation affecting buildings or land, purchaser shall furnish certificates, satisfactory to auctioneer, holding auctioneer harmless for any claims concerning damage or injury to persons or property arising out of any such acts. All equipment used in connection with removal, shall itself be removed with the purchased lots. All rights, privileges and powers reserved or granted to auctioneer in these Terms of Sale shall be deemed reserved and granted to auctioneer's employees, advertising representatives, and all owners for whom the lots are being sold. Auctioneer does not accept responsibility for the failure of any equipment sold to meet the safety standards on classifications of equipment by the Department of Labor Safety and Health Regulation, Federal OSHA or the Environmental Protection Agencies. It is the express responsibility of the buyer to determine what safety equipment must be in service on any machinery purchased and to comply with these regulatory requirements prior to using any equipment, machinery or vehicles purchased from Auction. In the event Auction Sales Co., LLC is required to employ an attorney to enforce any term of the agreement, purchaser agrees to pay reasonable attorney's fees, in addition to all court costs. Every person at the auction site before, during and after the auction acknowledges that he/she is there at his/her own risk with notice of the condition of the premises. No person shall have any claim against the Auctioneers, their agents, employees, sellers, owners, or principals for any injuries sustained or for any damages to or loss of property which may occur from any causes whatsoever. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor Auction Sales Co., LLC SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Auction Terms & Conditions - REGISTRATION & BID NUMBER ACCEPTANCE: By registering and accepting a bid number online, the bidder acknowledges they have read, understand, and agrees to be bound by the terms and conditions of Auction posted online in this document or available at auction site. When you sign up for a bidder number your credit card number will be retained and charged for your purchase(s), unless previous arrangements with management are made prior to auction day. By clicking the accept button online, you enter into a binding legal agreement with Auction Sales Co., LLC. Auction Sales Co., LLC is providing Internet online bidding as a service to Bidder. Bidder acknowledges and understands that internet service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Auction Sales Co., LLC or anyone else if their Internet service fails to work correctly before or during the auction. Internet bidders who desire to make certain their bid is acknowledged should use the Pre bidding feature and leave their maximum bid prior to the auction closing. Registered bidders are responsible and liable for all bids they place - intentional or accidental. Lots will have a "STAGGERED" and "SOFT CLOSE". You will be notified by email that you are the winning bidder. Email invoices will be sent as soon as the Auction closes. What is a "STAGGERED CLOSE"? The lots do not close all at the same time. Lots will have a staggered closing using a mixed sequence. Follow the clock to the right of each lot to know the exact closing time of a particular lot. What is a "SOFT CLOSE"?? If a bid is submitted and confirmed during the last 2 minutes before closing, then the time will be extended on that lot by 1 minute. This will continue until no more bids are placed on the lot. GENERAL TERMS OF AUCTION: It is the bidder's responsibility to preview and inspect the items prior to bidding/buying and determine the condition of the item they are bidding on. All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as announced by the auctioneer at time of auction. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. It is important that the buyer avail themselves of the inspection periods. All items sold "AS IS" meaning the bidder is responsible for due diligence in inspecting all items. Auction Sales Co., LLC will pass on any information, good or bad, that the seller provides when describing the items. Auction Sales Co., LLC is not responsible for incorrect listing information. However, it is up to buyer to determine the condition of the item they are bidding on. All sales are final. When a bidder is awarded the winning bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item. AUCTION SALES CO., LLC RESERVES THE RIGHT TO WITHDRAW, CHANGE OR RE-CATALOG ITEMS IN THIS AUCTION. ALL MEASUREMENTS ARE APPROXIMATE. BIDDING - Do not bid unless you agree to ALL of the terms and conditions posted herein. By bidding you are acknowledging agreement with all of the terms and conditions included herein and else where on our website. The highest Bidder shall be the Buyer and no Bidder shall retract their bid. A Buyer is deemed to have accepted an item or lot when they make their bid. A successful bid at auction constitutes a legally binding contract of sale. All sales are final. The acceptable bidding increments are established and controlled by the Auctioneer. Any dispute arising as to any bidding shall be settled by Auctioneer at his sole discretion, and Auctioneer may put the lot in dispute up for sale again. Auctioneer reserves the right to refuse any bid, which it considers to be an insignificant advance over the preceding bid. Certain items in the sale are being offered subject to reserve, which is the confidential minimum price below which such lot will not be sold. The Auctioneer has the right to place a bid for the consignor up to the Lot's reserve. Lots that fail to meet the reserve price may be represented for sale in another auction. Auction Sales Co, LLC reserves the right to allow any and all employees to bid. Seller and/or Auctioneer reserve the right to reject a Bidders registration application and/or bids for any reason in their sole discretion without prior contact to the Bidder. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. PAYMENT: Your credit/debit card number will be retained for this sale only, and charged for your purchase(s) at the close of the auction, unless prior payment arrangements have been made with Auction Sales Co., LLC staff prior to the close of the auction (auctionsalesco@gmail.com) An additional 3% processing fee will be charged for any card used. We accept: Visa, Mastercard, American Express and Discover. Purchases cannot be removed from the auction site until paid for in full. If paid for with non-certified funds, items will not be released until funds clear our bank. Payment in full is due prior to pickup. Auction Sales Co., LLC accepts cash, credit/debit cards, wire transfers and cashiers checks. BUYERS PREMIUM: Premium will be added to EACH LOT purchased at the following rate: Items selling up to $5,000.00 - 10% Items selling from $5,001.00 to $10,000.00 - 5% Items selling from $10,001.00 and above - 2.5% REMOVAL OF ITEMS/SHIPPING & HOLD HARMLESS: The buyer is solely responsible for removal and shipping of their own purchases. Items may be picked up by appointment only. Forklifts and forklift drivers will be on site to ASSIST in loadout if necessary. The buyer is soley responsible for verifying all items they have purchased have been loaded. Auction Sales Co. and their employee's are not liable for any item left behind by the buyer. All items must be picked up by the dates listed in this auction's details. ANY ITEM(S) NOT PICKED UP OR PAID FOR BY THE DATES LISTED IN THIS AUCTION'S DETAILS, WITHOUT PRIOR ARRANGEMENTS BEING MADE WITH MANAGEMENT OF AUCTION SALES CO, LLC, WILL BE DEEMED ABANDONED AND WILL BECOME THE PROPERTY OF AUCTION SALES CO. Successful bidders will be required to schedule an appointment for their load out. Successful bidders will be sent an email with their invoice which will include a link to sign up for a load out date and time. PURCHASER SHALL MAKE HIS OWN ARRANGEMENTS FOR INSURANCE COVERAGE FOR ALL ITEMS PURCHASED. The purchaser hereby agrees to indemnify and hold harmless Auction Sales Co., LLC, their employee's and the seller, against any and all liability, loss, costs, damages and other expenses arising from attending and purchasing at the auction or the loading out of purchased items and equipment by Auction Sales Co., LLC on the purchaser's behalf. All lots must be removed within the stated load out schedule. Any item not picked up or paid for by during these dates will be deemed abandoned and will become the property of Auction Sales Co., LLC. Items will be removed at purchaser's sole cost and risk, and only in a manner approved by auctioneer. Prior to the commencement of loading, dismantling, rigging or cutting or any operation affecting buildings or land, purchaser shall furnish certificates, satisfactory to auctioneer, holding auctioneer harmless for any claims concerning damage or injury to persons or property arising out of any such acts. All equipment used in connection with removal, shall itself be removed with the purchased lots. All rights, privileges and powers reserved or granted to auctioneer in these Terms of Sale shall be deemed reserved and granted to auctioneer's employees, advertising representatives, and all owners for whom the lots are being sold. Auctioneer does not accept responsibility for the failure of any equipment sold to meet the safety standards on classifications of equipment by the Department of Labor Safety and Health Regulation, Federal OSHA or the Environmental Protection Agencies. It is the express responsibility of the buyer to determine what safety equipment must be in service on any machinery purchased and to comply with these regulatory requirements prior to using any equipment, machinery or vehicles purchased from Auction. In the event Auction Sales Co., LLC is required to employ an attorney to enforce any term of the agreement, purchaser agrees to pay reasonable attorney's fees, in addition to all court costs. Every person at the auction site before, during and after the auction acknowledges that he/she is there at his/her own risk with notice of the condition of the premises. No person shall have any claim against the Auctioneers, their agents, employees, sellers, owners, or principals for any injuries sustained or for any damages to or loss of property which may occur from any causes whatsoever. SERVER & SOFTWARE TECHNICAL ISSUES In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Auction Sales Co., LLC reserves the right to extend bidding, close the bidding, temporarily suspend bidding, void any sale and re-sell any lots that were affected by the any malfunction. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor Auction Sales Co., LLC SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
