Sales Tax: HWY 70 On-Line Auction Co. will collect sales tax on all items in this auction, as required by TN state law. If you are buying for resale and have a reseller certificate, please email your certificate. 5. Outbid Notification: The on-line auction platform service provider will notify bidders when they have been outbid unless you have disabled in your preferences/profile. 6. Buyer Default: If, after the Payment Period has ended, the Buyer does not make full payment in accordance with the terms set forth above, the Buyer is considered in default and their Auction Item(s) will be re-listed in an Online Auction and a 15% re-listing fee. The acceptance of the Terms & Conditions implies you agree, the 15% re-listing fee, is a reasonable estimate of the minimum damages incurred by HWY 70 On-Line Auction Co. because of your failure to pay and will be charged to buyer. The re-listing fee is based upon the original selling price of the Auction Item. By registering a valid credit card, with the on-line auction platform service provider, the Buyer authorizes HWY 70 On-Line Auction Co. to charge applicable re-listing fees to the credit card. Abandonment: If paid items are not picked up or shipping requested (or paid) within the announced /published pick-up date and time, their items will be considered abandoned and will be disposed of. Unfortunately, HWY 70 On-Line Auction Co. is not currently able to offer storage space. 7. Debt Collection and Interest Charges: The bidder agrees to pay all reasonable attorney fees and other costs incurred by HWY 70 On-Line Auction Co. in its efforts to collect unpaid funds from the bidder. The bidder agrees to a fee of 2% of the outstanding balance per month be added to any unpaid balance due HWY 70 On-Line Auction Co. Any debt collection or dispute proceedings will be heard in Dekalb County, Tennessee. 8. Guaranty Agreement: By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to HWY 70 On-Line Auction Co. of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee. Any debt collection or dispute proceedings will be heard in Dekalb County, Tennessee. 9. Limitation of Liability: If, for any reason, HWY 70 On-Line Auction Co. is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of HWY 70 On-Line Auction Co., if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser. 10. Age Requirement: All bidders must be 18 years of age or older. 11. Shipping: Shipping is available with a $5 Handling Fee (per auction, not item) plus actual Shipping Charges. TN also requires Sales Tax on S&H. Insurance can be added (at your cost) please email and let us know. Packages are mailed with a tracking number and become your responsibility at the point the tracking number becomes active by the shipping carrier. HWY 70 On-Line Auction Co. is not responsible for lost or stolen packages. The better rate of USPS or UPS will be used. ***We offer home delivery by OTiS to: Rutherford Co, TN for $5; and Davidson Co., Williamson Co., Wilson Co., Jackson Co. and McMinnville for $10 upon request. Items not picked up will be shipped and you will be charged S&H Fees. If we are unable to ship (due to CC decline) items will be forfeited as outlined in the Terms & Conditions (Section 6). 12. Where Do Broken/Damaged Pallet Items Go? In a Pallet Palooza of Course! 25+ Pallets full of items from multiple truckloads (Am@zon, H*me Dep*t, L@we's, M@cy's, etc.). These BROKEN/DAMAGED pallets are perfect for the person able to repair small appliances, tools, etc. Or the person thinking outside the box, selling salvage parts (i.e. The coffee pots, the lids to coffee maker or the reservoirs) the possibilities are endless. In some instances, you maybe able to get inexpensive replacement parts from the manufacturer. With Google and You Tube one just never knows! It's amazing what you can do with eBay and Marketplace as outlets. We have held on to these things with the intent of doing this ourselves, but we just can't do it all! These BROKEN/DAMAGED pallets will start at $2 each and will sell with no seller buybacks. We only have pics to provide, we do not have any inventory lists or specifics to provide.
