* A 15% buyer's premium applies to all online purchases.

* No warranties of any type are expressed or implied concerning the merchandise being sold.
* After an item has been sold, it becomes the sole responsibility of the purchaser. All risk of loss passes to the buyer upon the declaration that the item has been sold.

* The auctioneer is the sole authority on any disputed bid, and his word is final.
* The auctioneer may remove items from the sale at his discretion.
* An invoice will be faxed and/or emailed to the winning bidder within 24 hours of completion of the auction. This invoice will be required to remove all purchased items.
Riggers/Shippers must have a copy of the invoice for the items they are picking up and show proof of a minimum 1-million dollar insurance liability.
* If a dispute arises out of this contract, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation before resorting to arbitration, litigation, or some other dispute resolution procedure. Any litigation which may arise is to be held in Latrobe, PA.
* Ages of machinery are determined from serial numbers to the best of our ability.
By registering for this auction, the customer agrees to the terms and agrees to hold Mark Ferry Auctioneers, Inc., its owners and employees, in addition to the owners, employees and landlord of the party or parties commissioning Mark Ferry Auctioneers, Inc. harmless from any and all losses involved in the removal of any and all equipment. They further agree to pay, in full, for any and all damages they may cause when removing the aforementioned equipment including, but not limited to, damage to floors, walls, doors, equipment or other machinery.
