Open House: For private showing of property - Contact Auction Company at 618-614-2779 BUYER'S PREMIUM: 5% REAL ESTATE TERMS: Successful bidder or bidders will be required to enter into a written contract and deposit $5000.00 earnest money on auction day. Balance due on or before closing. Deed and title insurance will be furnished by the seller. Possession will be given on date of closing. Five (5) percent (%) buyers' premium will be added to last bid for final amount. Make your financial arrangements prior to auction. Potential buyers may make any inspections prior to auction. GENERAL TERMS: The auction will be conducted by 3D Auctions on behalf of the owners of the property, referred to as the Seller. Auctioneer is not responsible for the acts or representations of Seller. The auction shall be governed by the terms set forth herein (the agreement), and any additional terms and conditions that are posted concerning the specific property. The Agreement constitutes a valid, binding contract between individuals participating in the auction with the intent to purchase property, referred to as the Bidder or Buyer, and Seller/Auctioneer. The term Bidder or Buyer shall include, but not limited to, the individual or the company represented by the individual and any and all of its agents, employees, representatives, officers, and directors. Auctioneer is not responsible for statements made by the Bidder, Buyer, or other parties. Auctioneer reserves the right to periodically change the terms and conditions of the Agreement, which shall be effective immediately upon posting. It is the Bidders responsibility to review any and all changes made to these terms and conditions prior to bidding on property. The act of submitting a bid shall constitute Bidder acceptance of each and every term and condition contained herein, any additional terms and conditions posted with the property, and any changes made within the full agreement. All persons attending, inspecting or removing property assume all risks whatsoever of damage or loss to person and property and specifically release the Auctioneer from all liability. Auctioneer is not liable by reason of any defect in, or condition of, the property or the premises on which the preview/sale is held. Auctioneer is released for any claims to actual damage to the property sold and/or consequential damages that may result from the sale of defective property. Real Estate Terms & Conditions: The real estate sells subject to all county and state laws, ordinances and regulations and any easements, encumbrances, leases and restrictions applicable to the property. Taxes and assessments will be pro-rated to the closing date. Conditions of Sale: This online only auction is not contingent on or subject to financing, appraisal, survey, or inspections of any kind, as agreed to by bidders at registration prior to bidding and specified in the Contract for Sale of Real Estate. Seller and Buyer(s) shall pay their share of the costs of closing. Buyer acknowledges they are buying property "as-is" without inspections or contingencies. Buyer (s) will rely on his/her own judgment and inspection. Closing: A buyer's premium of 5% is added to the high bid. Please take this into consideration when bidding. At the close of the auction, the successful bidder will enter into a written Contract for Sale of Real Estate within twenty-four (24) hours of the completion of the auction along with earnest money. If method of payment of the earnest money is made by credit card, there will be a 5% fee charged. The entirety of the remaining balance is due at closing. Buyer will be responsible for all wire transfers. Per the Contract, time is of the essence. Possession shall be given to the successful buyer(s) at closing. Seller will provide deed preparation. Liquidated Damages: Successful bidders not executing and returning their Contract with earnest money within 24 hours of the conclusion of the auction will be considered in default. If your closing is delayed for any reason, by you, as purchaser, or other parties working on your behalf, including any lender you involve, you may be declared in breach of the contract, forfeit all deposits made and could additionally be liable for any and all costs incurred by Seller and 3D Auctions incurred in a subsequent resale of the property. If such action occurs, 3D Auctions hereby has the right to disperse the deposit as stated in the listing agreement and the buyer has no claims to such money or property being sold. Liquidated damages are to cover cost of auction, cost incurred by seller, labor cost and additional cost of auction as not defined in this agreement. These liquidated damages do not restrict the seller from suing the buyer for performance damages and /or any additional damages the seller suffers by the default of the buyer. Other Conditions: There are no contingencies to this sale (ie. financing, appraisal, repairs, or inspections). Therefore, you should be pre-qualified by a lender prior to bidding if you require financing. 3D Auctions reserves the right to remove or cancel the bids and or bidding rights and privileges of any party at any time deemed not to be in the best interest of the seller. The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, 3D Auctions will reject the registration, and bidding activity will be terminated. 3D Auctions has timed events. This auction has an extended bidding or "soft close" feature. When a bid is submitted in the final two minutes of the auction for a lot, the bidding for that lot will be extended for an additional two minutes. this will continue until there are no longer any bids submitted for that individual lot. Real Estate Brokerage Services Disclosure: 3D Auctions and their representatives are exclusive agents of the seller(s). We do not represent the buyer(s) in any manner and we must be completely loyal and faithful to our client. 3D Auctions has an exclusive right to sell listing for this transaction. All negotiations must be conducted through 3D Auctions. 3D Auctions involvement in this contract: The seller and buyer hereby agree that 3D Auctions is a part of this contract and shall receive compensation as stated in the agreement hereto or as stated in the listing agreement hereby made a part of.
