TERMS & CONDITIONS OF SALE
ABSENTEE BIDDING INFORMATION
1. Your bids will be executed at 10% Buyer’s Premium on Absentee Bidding Only. No Buyers Fee if at Live Auction.
2. Absentee & Internet bidders are responsible for any errors in their entry.
The Auctioneer cannot accept responsibility for your errors. Bidder must be 18 and older.
3. Absentee/internet bidders must provide their full name, postal address,
Email address, and phone number when placing a bid.
4. Payments for lots must be made within 7 days upon notification by phone or e-mail. Shipment will be by USPS First Class with delivery confirmation & insurance. All postage and handling shall be paid by the Buyer. Insurance is a MUST.
5. PAYMENT TERMS: Cash, money order, certified check. Credit cards, Paypal or other forms of electronic payment are NOT ACCEPTED. A holding deposit may be required from a Floor Bidder paying by personal check and not known to the Auctioneer.
6. Grading of all lots appearing in this auction are the opinion of Original Owners or Estate. Lots may also have been graded by a professional grading service and are listed as such. No warranty, expressed or implied, is made as to the grading, which may vary among individuals. Grade to your own Standards.
7. Lots purchased by Floor Bidders or Absentee Bidders cannot be returned. Inspect all lots before bidding.
8. Title for all lots remains with Auctioneer, until full payment is received and checks are processed and cleared.
9. If there is a dispute between Bidders, the final award shall be determined and settled by the Auctioneer.
10. Absentee/Internet bids must be received no later than 6:00 PM the day before the Live Floor Auction. Absentee/Internet Bidders will have their bids entered into the Live Floor Auction up to the limit of their stated maximum, if necessary and will be executed like Absentee Bidder was there.
11. If there are duplicate bids, the lot will be awarded to the first bid received by the Auctioneer. Any tie bids between an Absentee/Internet bidder and a Floor Bidder shall be awarded to the Floor Bidder.
12. Any lot determined to be inaccurate or any kind of mistake may be withdrawn from the auction by the Auctioneer at any time.
13. The placing of a bid constitutes acceptance of the Terms and Conditions of Sale. If you do not agree with any of the above DO NOT BID
14. No Absentee Bidder Information will be shared with anyone other than Smith Auction Svc.
