Unfortunately, we have had to strengthen and continue to add to our terms and conditions as of late. 1. BY BIDDING YOU HAVE AGREED TO ALL THE "TERMS AND CONDITIONS" LISTED. WE DO NOT SHIP. All items sold as is where is with all faults. There are no warranties or guarantees of any kind either expressed or implied. All descriptions believed accurate, buy not waranteed. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. All sales are final. We do not give refunds. A preview time has been provided for your careful inspection. YOU ARE BIDDING ON YOUR OWN EXPERTISE. NO REFUNDS WILL BE GIVEN ON ANY ITEMS THAT WERE DAMAGED PRIOR TO AUCTION PICKUP OR ITEM NOT LABELED CORRECTLY AND NOT INSPECTED BY THE BIDDER ON PREVIEW DATE. When in doubt about an item description; do not bid. 2. Auctions are set to stagger closing of 15 seconds and a soft close of 2 minutes will apply per lot discouraging auction sniping. 3. All items may or may not be labeled correctly IT IS 100% BIDDER RESPONSIBILITY to review pictures and/or attend AN IN PERSON PREVIEW of the item. Gander & Gavel Auction Co. LLC makes every effort possible to document patterns, colors, markings, flaws, etc in photos as items are catalogued. IT IS 100% BIDDER RESPONSIBILITY TO VIEW PHOTOS AND BID ON BIDDER'S OWN EXPERTISE. If you have ANY DOUBTS about an item we would encourage you not to bid on it. Photos provided by Gander & Gavel Auction Co. LLC should be used as THE FIRST INDICATOR OF FLAWS, marking, maker, etc. Auction company does not always indicate flaws in writing due to the hundreds of lots we handle. Lot numbers on Hibid are the parent lot number and therefore supercedes the lot number in the item photo. Bidders are bidding on the item in photo by way of the lot number on HiBid. 4. We have a ZERO TOLERANCE social media extortion policy. Any bidder who indicates verbally or in writing to us that they will use social media against Gander & Gavel Auction Co. LLC as leverage to break their buyer contract agreement WILL have bidding priviledges permanently terminated on the spot. Bidders agree to terms & conditions upon registration. THE BUYER AGREEMENT IS A BINDING AGREEMENT. 5. Payment must be made using American Express/MasterCard/Visa/Discover. Due to current Covid-19 only card payments will be allowed for purchases. All balances will be paid before auction items will be allowed to leave. All currency is under USD. 6. Please do not leave comments for auctioneers in bidder registration or contact Gander & Gavel Auction Co. LLC indicating any preferences that go against terms & conditions you have agreed to. This includes forms of payment, pick up day/time, etc. 7. There is a 15% Buyers Premium added to each purchase as part of the purchase price. North Carolina sales tax is applicable unless you are exempt and have supplied the Auction Company with proper documentation PRIOR TO CLOSE OF AUCTION. Tax exempt bidders must provide a copy of their tax exempt certificate with us with valid expiration date. Supplying Gander & Gavel Auction Co. LLC with your tax exempt ID number alone will not suffice. 8. The auctioneer is the sole judge in the event of a disputed bid. The auctioneer may reopen the bidding at his or her discretion. The highest/successful bidder acknowledged by the auctioneer shall be the purchaser and thereupon assumes full risk and responsibility. Purchaser will sign for and pay full price for the said lot. 9. All items are held to/with a minimum and/or reserve bid unless specified. The owner(s) of the items and his or her representative are not allowed to bid on the items offered for auction. Auctioneer may remove items from auction with no warning upon consignor request; due to mutual agreement between said consignor and auctioneer. 10. Pick up time for the auction items posted for the auction are set. It is the responsibility of the the buyer(s) to pick up items at the specific place, date, and time advertised in the auction listing. PICK UP FOR AUCTION ITEMS ARE ONLY ALLOWED ON SATURDAY PICKUP DATES AND TIMES. NO OTHER DATE AND TIME WILL BE ALLOWED. AFTER 30 DAYS ALL ITEMS NOT PICKED UP WILL BE DONATED OR RESOLD WITH NO REFUNDS GIVEN. All items must be removed on pickup day unless other arrangements are made PRIOR to the pickup day. WE DO NOT SHIP ITEMS. IT IS THE BUYERS RESONSIBILITY TO CONTACT SHIPPING COMPANY TO PICKUP AND SHIP THE ITEMS TO THEM. Gander & Gavel Auction Co., LLC is not responsible for items damaged during shipping or items not delivered since we do not pack and ship items 11. We have a ZERO TOLERANCE POLICY FOR BIDDERS WHO USE EXCUSES LATER ON AS TO WHY THEY SKIPPED THE DESIGNATED PICK UP DAY AND TIME. We supply bidder with an emailed invoice at the close of an auction with the date, time, and location of pick up on invoices, pick up date, location, and times are advertised well in advance. We also typically call/text bidders 2 hours prior to close of pick up day. Therefore, bidders have had ample time to prepare. Bidders are responsible for contacting Gander & Gavel Auction Co. LLC in advance PRIOR to the start of pick up if alternative arrangements are needed. 12. Buyers who fail to show for the designated pick up day without contacting us prior to pick up their items will have their account frozen until items are picked up. No show buyers will not be allowed to bid in our auctions until their items are picked up on a future scheduled pick up day. All items left after 30 days become the property of Gander & Gavel Auction Co. LLC 13. BUYERS are responsible for removal of items and providing own packing and transport materials for items purchased. Auction company does not supply boxes and packing materials nor cannot aid in the removal or packing of items from/at pick up location. 14. Announcements made the day of the sale supersede and take precedence over any previous announcements or advertisements. 15. Unpaid items will be forfeited if bidder does not pay before pickup time begins since buyer contract is broken by not following "terms and conditions". Unpaid forfeited items will be sold and non-paying bidder WILL automatically lose bidding priviledges. 16. ALL ITEMS NOT PICKED UP BUT PAID FOR WILL BE CONSIDERED FORFEITED AND RESOLD AFTER 30 DAYS. 17. It is not Gander & Gavel Auction Co., LLC responsibility to ensure buyers/sellers check their personnel email accounts. Emails are sent to winning bidders within 24 hours after the auction closes. Dont forget to check your "spam" or "junk" email folders for our emails along with the "inbox" folder. 18. VIOLATION OF TERMS & CONDITIONS MAY LEAD TO BUYER BIDDING PRIVILEDGES BEING PERMANENTLY TERMINATED. 19. AUCTION PICK UP DATE: DECEMBER 5, 2020 STARTING AT 12:00PM (noon) AND ENDING 5:00PM. We do not allow buyers to continue to bid on items in subsequent auctions when they have not picked up items from previous auctions. 22. Any props used to photograph and catalogue lot items are not included unless other wise specified. This includes, but is not limited to: plate stands, dress forms, tables we use to photograph items on etc. 23. We do not allow buyers to stockpile items in our auction house due to limited storage.
