REAL ESTATE TERMS & CONDITIONS
AUCTION LOCATION.The property will be sold Online only. Please refer to auction start & end times.
AUCTION REGISRATION. All bidders must register to bid on our website and provide a valid credit card. The credit card used will only be charged if the winning bidder defaults (see DEFAULT below).
WINNING BIDDER. The winning bidder (Purchaser) shall be the best and highest bid prior to auction conclusion. Purchaser shall be notified at the conclusion of the auction by electronic mail. Auction Firm’s designation of the Purchaser shall be final.
FREE & CLEAR DEED. The property shall be sold free of any lien with an insurable General Warranty Deed. Possession of the property will be 30 days after closing.
BUYER PREMIUM/CONVENIENCE FEE. There will be a 10% buyer premium added to the high bid amount to determine the full purchase amount to be paid at closing. By example, if you’re the Purchaser at a high bid of $50,000, your contract purchase amount will be $55,000.
DOWN PAYMENT. Purchaser shall make a down payment of 10% of the full purchase amount on the property within 36 hours of auction conclusion, and acknowledge all requested/required paperwork. Required paperwork will consist of Purchase Contract, and Agency Disclosure. Copies of the required paperwork shall be available for review prior to the auction beginning on our website at www.SempleSells.com.
BIDDER DEFAULT. As a Bidder, placing a bid is a binding contract between you and the Owner/Seller and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to close on the transaction at the said price you indicated as your bid, including the addition of the buyer premium. If the Purchaser fails to sign the Contract to Purchase at Online Public Auction, or fails to remit the required down payment with the contract, Purchaser hereby grants to auction firm a Limited Power of Attorney to sign on their behalf, making the contract valid and enforceable and the down payment is hereby authorized to be charged to the credit card used to register for the auction.
PURCHASE CONTRACT. A sample Contract To Purchase At Online Auction (“Contract”), along with any other State or Federally mandated forms, will be on the website for Bidders to review only. The completed contract and forms will be sent via email to the winning bidder within 24 hours of the auction conclusion for acknowledgement. The Purchaser shall sign the contract and forms and return via US Mail along with the down payment amount by company or personal check within 36 hours of receipt. Note – if purchaser desires to wire transfer the down payment, please contact Cindy Chambers at 513.724.1133 for wiring instructions. Completed/signed contracts and down payments can be mailed to Semple International, Inc., 278 N. Third St., Williamsburg, OH 45176.
CLOSING. All closings shall be conducted at a title company, attorneys’ office, or bank licensed to do business in the State where the property is located. The costs of closing the transaction are the responsibility of the Purchaser. These costs include, but are not limited to, attorney/title company fees, deed preparation fee, transfer taxes, title exam, and title insurance (if desired). Seller shall pay all delinquent taxes ( if any) as well as all tax prorations to date of closing.
BUYER BROKER/AGENT REPRESENTATION. No broker co-op commission is offered.
AGENCY The employees of Semple International, Inc. are acting solely as agents for the seller.
