Registration:
a) Consignment Depot reserves the right to require cash, money order or wire transfer for payment
b) Before bidding you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you click the "Register to Bid" button, you enter into a binding legal agreement with Consignment Depot.
c) Registering to bid is free. You must provide a credit card during registration. This card will be charged for any items you are high bidder on. Amount charged will include high bid price, Buyer�s Premium and any applicable sales tax.
Bidding:
a) All bids submitted are final and irrevocable, whether they are submitted in person, online or by proxy. If you are the highest bidder you are the new owner of that item. All sales are final.
b) Most items are sold without reserves, minimums or limits. Consignment Depot expressly forbids owners and their agents from bidding on any item they have consigned to an auction. Any items with a reserve will be declared so the bidder is fully aware that the item has a reserve price that must be met for the item to sell.
c) Consignment Depot reserves the right to refuse bids from any individual. Successful bidders are required to pay a Buyer�s Premium on each item purchased. The Buyer�s Premium is 15% on this auction. (3% discount for cash) Cash customers need to pay for purchases or contact us with 24 hours of close of auction.
Condition of Items:
a) All items are sold �as is, where is.� We make no representations or warranties with respect to the items in our auctions. We recommend that you visit our gallery or the auction site to inspect any items you�d like to buy before bidding. You may also send someone to the site to conduct the inspection on your behalf.
b) No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold �as is� and without recourse.
c.1) Descriptions are provided to help identify an item and create interest. Descriptions are not complete or exhaustive. It is up to the buyer to determine the condition of the item BEFORE they submit a bid.
c.2) c.2) GEMSTONES: Consignment Depot LLC does not warranty the authenticity of gemstones and certain gemology grading companies. It is solely up to the buyer to do thier own research on gemstones and the grading company to determine if a gemstone is authentic and before placing a bid. Consignment Depot LLC will do its best to answer any questions or add any extra picture that might be requested if request is sent in a timely manner. Keep in mind that our office hours are Tuesday through Saturday 9am - 5pm (PST)
d) APPRAISALS & OPINIONS OF VALUE: All values including appraisal prices and auction estimates are to be used as guidance and are not guaranteed by the auction company or the third-party appraisal company. No appraisal or auction estimate should be used as a suggestion of resell value. Opinions of value and quality of stones can vary greatly among "experts" based on current market conditions, availability in the market place, geographical location, gemological equipment types, method of grading and the evaluator's training. Such variances do not constitute any error on either evaluator. Consignment Depot LLC does not warranty any opinion of value. As is customary in the jewelry business, when items are manufactured and are so similar in makeup that there is no difference in weight or appearance, a certificate may be duplicated for each piece that is manufactured and evaluated by the appraiser. Appraisals should be used for verification of gemstone and/or metal weight, size and grade only, not actual value. Items should not be purchased with the expectation to resell for appraisal price or for profit.
Responsibility and Ownership:
a) Every item becomes the responsibility of the new owner as soon as the online auction is concluded. If you are the highest bidder, you are responsible for insuring your purchase immediately.
b) Buyer should come prepared to pack and load their items. Buyer assumes all responsibility of personal items/property in/on their vehicle and Consignment Depot LLC will not be held responsible for any damage. Buyer assumes all responsibilty for loading and unloading of their property. We may be able to assist, but cannot guarantee staff will be available to assist everyone.
Payment:
a) Purchases must be paid in full before items can be picked up.
b) Cards will automatically be charged the Saturday following the auction. If you intend to pay cash, we will need to notified by the Friday following the auction.
c) Any items not paid for or picked up within 3 days of the concluded auction we be deemed abandoned and sold at a future auction or returned to the seller. Refunds will not be given on abandoned items.
d) If Consignment Depot cannot make available or deliver clear title on a purchase, the buyer is entitled to a full refund of the purchase price upon immediate return of the item. Item must be returned in the same condition as it was prior to the sale.
e) Resellers must submit an ST-101 before the conclusion of the auction. Failure to do so will result in sales tax being charged. This form can be found at: http://tax.idaho.gov/forms/EFO00149_09-30-2015.pdf
f) Buyer specifically waves the right to dispute or deny payment for any purchases made with a credit card.
Firearms:
You must complete a 4473 and pass a NICS background check to take possession of firearms in this auction. Out of state buyers - firearm will be shipped to FFL license holder only. If you believe you cannot pass a NICS background check, DO NOT BID. If you do not pass the NICS background check, the Buyer's Premium will still apply and not be refunded.
Submitting a bid signifies your agreement to these terms. If you do not agree to or understand any of these Terms and Conditions, DO NOT BID.
Auction end time may be extended at any time for any reason.
