TERMS AND CONDITIONS OF SALE 1. Cash or check (with 2 ID’s), on day of sale. All out of state checks and business checks must be accompanied by a bank letter of credit. 2. While the Cozart Auction Service has endeavored to catalogue and describe the property correctly, all property is sold “as-is” and neither Cozart Auction Service nor the consignors will be responsible for the description, genuineness, provenance, condition, fitness or merchantability of the property. No statement contained in the catalogue, advertising or made orally at the sale or otherwise shall be deemed to be any warranty (express or implied) or representation or an assumption of liability. 3. The highest bidder acknowledged by the auctioneer shall be the purchaser (subject to the right reserved by the Seller to reject any and all bids). At that moment, title passes to the designated bidder, thereupon assuming full risk and responsibility for said item. In the event of any dispute between bidders, the auctioneer shall have absolute discretion to determine the successful bidder, in which event this determination shall be final, or to re-offer and re-sell the article in dispute. 4. If any dispute arises after the sale, the Cozart Auction Services sale record shall be conclusive as to who was the purchaser, the amount of the highest bid, and all other issues regarding the sale. 5. No items purchased during the auction may be removed prior to payment in full without the prior written consent of the auctioneer (which shall be at the sole discretion of auctioneer and shall require a $100.00 non-refundable deposit with the balance due within 3 business days). 6. The auctioneer or representative of Cozart Auction Services may act on behalf of the absentee Bidders; that is, place bids on items by non-attendees who wish to participate as bidders/buyers in the auction. @ 10% Buyers Premium. 7. The Cozart Auction Service reserves the right to ask any person or group of people to leave the auction if in the opinion of the auction staff at the individual or group is acting in any manner that the auction company deems is detrimental to the auction company or its consignors. 8. Announcements on the day of sale shall supersede any and all printed ads.
