If you do not understand any of these terms or conditions, please ask a staff member for clarification before registering. 10% Buyers premium will be added to each lot purchased. 1. Identification; All purchasers are required to registeAr through Auction Flex/ HI bid. Prior to becoming authorized to bid online! In the event of onsite auction each potential buyer must register at the auction site with proper identification and address. 2. Addition or withdrawal from auction; The Auctioneer reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all of the items listed in bulk. 3. The auctioneer has the right at his absolute discretion to refuse any bid. The highest bidder shall be the buyer at the hammer price. 4. Dispute between bidders - If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. There is no such thing as a tie bid!! Once the Auctioneer says sold, the item is no longer up for auction, unless the item is brought back to the auction block with an agreement by each bidder that the item be resold and open to the entire. Discretion of Auctioneer. 5. Condition of items sold - The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. 6. Manner of payment - All lots are to be paid in full by cash, approved check at onsite pick up or auction, Returned check will result in a $150.00 for any check returned from any bank for any reason! Larry W Richie Auctioneer reserves the right not to accept any check at any time or any reason. 7. Illinois sales tax; Illinois has now started taxing some auctions and auction items. In the case of an auction or auction item being taxable by Illinois law, the applicable tax will be added to each item 8. All measurements and sizes - are approximate. 9. Removal - shall be at the expense, liability, and risk of the purchaser. Purchases will be delivered only on presentation of paid bill. Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased. Property and Personal Risk; Persons coming to pick up their purchased items assume all risks of damage of or loss to person and property! They also, release Auctioneer and personnel from liability therefore. The Auctioneer nor staff shall be responsible of nay defect in or condition of the promise of where auction is held. 12. Record of Auction; The record of auction will be kept by Auctioneer will be taken as final in the event of any dispute; 13. All lots - to be sold AS IS, WHERE IS. ALL SALES FINAL. No warranty, guarantee, expressed nor implied. 14. This sale is being conducted pursuant to Section 2328 of the Uniform Commercial Code and Section 53.5 of the Penal Code. 15. Additional terms and conditions - Any additional terms or conditions of sale, added by auctioneer, shall be announced prior to auction, or listed in writing prior to the start of any auction. Breyer horses from a very large collection. We will sell approximately 300 per each auction and i could take us 15 to 16 auctions to complete this collection. The seller (Patsy) has been collecting since 1957 .. There will be several in boxes, however the majority have no boxes (DARN IT) The horses has been on display forever, mostly in enclosed glass cases and lots on shelves in her home. We are inspecting each and everyone as we list! We are human, and might miss a damaged item along the line. When you recieve your items please check them over , if there is a problem we will take care of it immediately. If you are picking up, inspect on site!!!! BELIEVE OR NOT BELIEVE; During catalouging , I found 2 items with damage (i can not find the paper i wrote them down on) DUH? They are marked on the catalogue and photos. If I do fins them, I will definatley post which ones they are.
