The absence of a condition statement does not imply that the lot offered is in good condition. The photo captions, catalog, internal or external search engines, advertising and/or auctioneer’s statements, etc, are a courtesy provided by Spartan Auctions, LLC, and meant as a descriptive guide only. The bidder is cautioned to use the preview and/or photographs to examine all merchandise using his/her best judgment as to whether or not the photo captions, catalog, internal or external search engines, advertising and/or auctioneers statements, etc, are accurate. Spartan Auctions, LLC reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to the commencement of bidding. ​​ Spartan Auctions, LLC and its consignor(s) make no warranty or representation, expressed or implied that the bidder will acquire any copyright or reproduction rights to any lot sold. Spartan Auctions, LLC reserves the right to reproduce any image of any consigned lot. Spartan Auctions, LLC is the exclusive owner of all images used on our website. Unauthorized reproduction will be prosecuted to the fullest extent of the law. Spartan Auctions, LLC reserves the right to withdraw any lot at any time prior to the commencement of bidding for such lot. The purchase price payable by highest in-house, absentee or telephone bidders shall be the sum of the final bid plus the buyer’s premium of 10% for cash or check, and 13% for credit card. ​ All highest bid purchase prices will be in U.S. dollars. We accept cash, checks (with proper identification and an approved bank letter of guarantee), Visa, MasterCard, Discover or American Express credit. All items must be paid in full prior to being removed from the premises. ​​ Consignors are responsible for arranging their own lots. Lots or lot components are expected to be in working condition, as well as clean and presentable. Any lot containing items found to be non-working or dirty, can be returned or disposed of at Spartan Auctions, LLC discretion. ​ Spartan Auctions, LLC reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of a dispute between bidders, the auctioneer has the final discretion to determine the successful bidder or to re-offer the lot in dispute to any point where a bid may have been acknowledged. If any dispute arises after the sale of any lot, Spartan Auctions, LLC sales records shall be conclusive. ​ No auction lot may be removed during the sale or at any time until the full purchase price has been paid. All lots must be so paid and removed at the highest bidders expense by the time announced at the current auction. Buyers agree to removed ALL items that they purchased, and agree not to leave partial lots on the premises. Spartan Auctions, LLC will not be held responsible for loss or damage to items not picked up the day of the sale. The buyer agrees to take ownership and responsibility for all items at the close of bidding for such item. Spartan Auctions, LLC does not provide assistance in the removal of any lot purchased by the highest bidder, nor does Spartan Auctions, LLC provide any packing or shipping materials required for the safe or secure removal of any lot, except for sales made to internet bidders paying for Duke City Auctions shipping, if offered. Not all internet auctions offer shipping services by Spartan Auctions, LLC. If shipping is offered by Spartan Auctions, LLC, it is usually offered at USPS published rates based on weight and destination plus a nominal fee for packaging and/or handling. Oversized or heavy items may be shipped via other carriers of Spartan Auctions, LLC choosing. Bidders may contact Spartan Auctions, LLC before an auction event and receive an estimate for shipping for any particular lot in an upcoming sale, though actual shipping cost may differ from an estimated cost for any reason. If, for any cause, a purchased lot is found to be stolen, broken or lost prior to highest bidder pickup during the day of, or after the end of the day of sale, Spartan Auctions, LLC shall not be liable for any amount paid by the purchaser. It will be at Spartan Auctions, LLC's discretion if any refund or partial refund will be allowed. ​ Employees of Spartan Auctions, LLC are not prohibited from bidding on lots. In the course of their employment it is possible that they may have access to information not available to the public. ​ All measurements and weights offered for any lot by Spartan Auctions, LLC are approximate and are made as a courtesy to bidders. ​ Spartan Auctions, LLC is not responsible for typographical errors in regard to any description of any lot offered for sale.​ Spartan Auctions, LLC is not responsible for damage of glass covering paintings, drawings, and other works or frames regardless of cause. ​ Spartan Auctions, LLC will not guarantee the authenticity of any signature unless so stated at the time of auction. ​ Any concerns or questions of these terms and conditions must be made known to the auctioneer prior to accepting a bidding card and/or consignment of any item.
