- This is an absolute auction. There are no minimum bids on anything being sold today. All items will be sold to the last bidder regardless of price. - Acceptance of a high bid is a legal and binding contract enforceable in a court of law. - ALL ITEMS ARE SOLD AS IS! ALL SALES ARE FINAL! There are no warranties expressed, written or implied, as to the merchantability, fitness for use, age, description, or condition of any item in the auction. We do not represent or guarantee the hours on used equipment. It is the sole responsibility of the bidder to inspect each item and bid accordingly. IF YOU ARE UNSURE OF THE CONDITION OF AN ITEM, DO NOT BID ON IT! - PAYMENT- All onsite purchases must be settled for in full on auction day. Online purchases must be paid in full by the end of the day on the Monday following the auction. Payment may be made by cash, check, debit card, credit card or cashier's checks. We prefer online payment to be made by wire transfer. Personal and company checks will be accepted however we will not release your items until your check clears. We will not exchange your check for cash on the next business day. - There is a 7% onsite buyer's premium and a 10% online buyer's premium added to every purchase. There is a 3% surcharge added for credit card purchases. No surcharge for Debit Card. - 7% Sales Tax is collected on all titled vehicles unless a current auto dealer's license is on file UPON REGISTRATION. Items must be removed by the Friday following the auction. Removal times are two hours after the auction today, and from 9:00 to 4:00 Monday thru Friday. - Titles will not be processed until the item is removed from the auction lot. - All items left on the auction lot after 10 days are subject to a $20.00 per day per item storage fee. All items left after 30 days are subject to sale at the next scheduled auction for storage fees. - Garner and Associates Auctioneers and Bartow Ford will not be responsible for lost, stolen, or damaged items left after the auction. - Any legal disputes will be settled by binding arbitration in the jurisdiction of Polk County. - Tampering with or disabling items in the auction constitutes bid rigging and collusion and is a federal crime. It is a violation of theUnited States Sherman Anti-Trust act and will not be tolerated. Anyone found engaging in this activity will be subject to arrest and prosecution and bidding privileges will be permanently revoked. TITLE POLICY - Bartow Ford will collect all title fees and process all titles. If purchases are paid for by a personal or company check, titles will not be processed for 10 business days. - Titles will only be put into the name of the person(s) who is the high bidder on that item. No exceptions! If you purchase a titled vehicle, you must see the title clerk before you leave the auction TODAY.
