Listing Terms and Conditions |
---|
Registration:
a) Before bidding you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you click the "Register to Bid" button, you enter into a binding legal agreement with Spokane Estate Liquidation Auction.
b) Registering to bid is free. You must provide a credit card during registration. This card will be charged for any items you are high bidder on. Amount charged will include high bid price, Buyer's Premium and washington sales tax. In cases where the primary buyer cannot/does not pay the secondary bidder will take the item and be charged.
Bidding:
a) All bids submitted are final and irrevocable, whether they are submitted in person, online or by proxy. If you are the highest bidder you are the new owner of that item. All sales are final. Unless items have a COA they are sold as is and as shown. We cannot guarantee an item if there is no COA (certificate of authenticity). However if an item says something like "it turns on" but it doesn't of course cases like that will be refunded.
b) Most items are sold without reserves however, any items with a reserve will be declared in the notes so the bidder is fully aware that the item has a reserve price and what it is in the notes.
c) Spokane Estate Liquidation Auction reserves the right to refuse bids from any individual. Successful bidders are required to pay a Buyer's Premium on each item purchased.
d) All items are sold "as is, where is." We make no representations or warranties with respect to the items in our auctions. We recommend that you closely inspect our photos or come by appointment to the auction to inspect any items you'd like to buy before bidding. You may also send someone to the site to conduct the inspection on your behalf.
e) Descriptions are provided to help identify an item and create interest. Descriptions are not complete or exhaustive. It is up to the buyer to determine the condition of the item BEFORE they submit a bid.
f) APPRAISALS & OPINIONS OF VALUE: All values including appraisal prices and auction estimates are to be used as guidance and are not guaranteed by the auction company or the third-party appraisal company. No appraisal or auction estimate should be used as a suggestion of resell value. Opinions of value and quality of stones can vary greatly among "experts" based on current market conditions, availability in the market place, geographical location, gemological equipment types, method of grading and the evaluator's training. Such variances do not constitute any error on either evaluator. Spokane Estate Liquidation Auction does not warranty any opinion of value. As is customary in the jewelry business, when items are manufactured and are so similar in makeup that there is no difference in weight or appearance, a certificate may be duplicated for each piece that is manufactured and evaluated by the appraiser. Appraisals should be used for verification of gemstone and/or metal weight, size and grade only, not actual value. Items should not be purchased with the expectation to resell for appraisal price or for profit.
g) Buyer should come prepared to pack and load their items. We may be able to assist, but cannot guarantee staff will be available to assist everyone.
h) Purchases must be paid in full before items can be picked up. Cash can be used for 3 days after auction, afterwhich cards on file will be charged. You have 3 days from AUCTION CLOSE to let us know of missing items or items that were not working that we claimed were if it applies.
I) Any items not paid for or picked up within 4 days of the concluded auction we be deemed abandoned and sold at a future auction or returned to the seller. Refunds will not be given on abandoned items. In events that we make accepting to this rule we are not liable for items that are missing after the 4 days as they should have been resold.
j) If we cannot make available or deliver clear title on a purchase, the buyer is entitled to a full refund of the purchase price upon immediate return of the item. Item must be returned in the same condition as it was prior to the sale.
k) Resellers must submit an reseller permit before the conclusion of the auction. Failure to do so will result in sales tax being charged.
l) Buyer specifically waves the right to dispute or deny payment for any purchases made with a credit card.
m)Submitting a bid signifies your agreement to these terms. If you do not agree to or understand any of these Terms and Conditions, DO NOT BID.
n)Auction end time may be extended at any time for any reason.
o) Shipping is done fridays of every week. We will charge cards upfront for your purchases so we can be sure all items are paid for by shipping day. We price shop USPS, UPS, and Fedex to get the cheapest shipping we personally are able. We use what boxes we have here at our location and cannot guarantee any certain kinds of boxes. We will ship to the location that is on your invoice so please update settings to reflect that. We cannot ship items that are combustable or against federal guidelines. Items that say "shippable" are the ones we will ship. If an item is won that does not say shippable than we will do our best to ship if possible but any breaking will not be covered as we didn't mark is as being able to be shipped usually that being the reason. All Orders that shipping is needed are subject to insurance and a signature on every order. If you are the highest bidder on multiple lots, we will combine to save on shipping charges. Cost of shipping cannot be cause to rescind sale. If a package is returned due to non pick-up or incorrect address from the customer, that is to say not by fault of the auction, items will be rerun without refund.
p) Blocking:
If a bill is not paid and goes into default, you will be blocked from our auction until your debt is collected. If you need shipping funds are pulled the following day for your items purchased so it can move onto boxing, measuring, and weighing. If you are a pickup you have 3 days to pay in cash and then cards are charged. If in either case your card does not process we will ban your account until it's resolved.

I.A) ANY ITEMS NOT PAID WITHIN 4 DAYS OF THE AUCTION CLOSE WILL be deemed abandoned, a block will be put on your account until it's paid and a note WILL be left on your hibid account that all other auctions can see that you did not pay and these items will be sold at a future auction or returned to the seller.
I.B) The following doesn't pertain to you if you require shipping. ANY ITEMS NOT PICKED UP WITHIN 3 DAYS OF THE AUCTION CLOSE WILL incur holding fees in the amount of $5 PER DAY after the 3rd day. If the storage fees reach the point that it equates to the order itself your item will be deemed forfit and rerun in the next auction WITHOUT REFUND. This is not to punish, we need to keep items circulating and it seems when we allow for extra time there are those that take advantage and we have to keep the business running.
j) If we cannot make available or deliver clear title on a purchase, the buyer is entitled to a full refund of the purchase price upon immediate return of the item. Item must be returned in the same condition as it was prior to the sale.

Cost of shipping cannot be cause to rescind sale. If a package is returned due to non pick-up or incorrect address from the customer, that is to say not by fault of the auction, items will be rerun without refund.
FUNITURE (or items that will not fit our boxes at our shop): We have found a company that will transport larger items and furniture. We will ship these. HOWEVER, we do not set these prices. They will be expensive. This would be a trucking company quoting us to ship furniture throughout the US. Trucking is very expensive, especially currently, failure to pay shipping will result in loss of items and a ban with notes to all hibid auctioneers.
p) Blocking:
