Listing Terms and Conditions
Registration: a) Before bidding you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you click the "Register to Bid" button, you agree to these terms & conditions and enter into a legal binding agreement with Spokane Auctions LLC. b) Registering to bid is free. You must provide a valid debit or credit card during registration. This card will be charged for any items that you win the highest bid on. The amount charged will include the winning bid price, the Buyer's Premium; see "Bidding" Paragraph c) and any applicable sales tax. c) Absentee and or Live Bidding in Person at the showroom location of Spokane Auctions LLC requires the bidder to complete a "Registration Form" and provide an accepted form of payment prior to being able to submit a bid. For a cash bidder, a Cash Deposit of 50% of the bid is required to for the bid to be accepted for any item(s). If none of the item(s) were won by the bidder, the cash deposit will be immediately returned to the bidder on the following day of the auction bidding closure. If any of the item(s) were won by the bidder, the cash deposit will be applied to the winning bidders invoice. d) Spokane Auctions reserves the right to extend the auction end date or time for any reason. e) There is a $5.00 Minimum Invoice Purchase if you are paying with any type of Payment Card, so if you win items under that total under $5.00, a "Minimum Invoice Fee" will be added to raise the invoice total to $5.00 Bidding: a) All bids submitted are final and irrevocable, whether they are submitted in person, online or by proxy. If you are the highest bidder, you are the new owner (Buyer) of that item and are under contract to fulfill and finish the sale. All sales are final. b) Most items are sold without reserve prices, but Spokane Auctions LLC reserves the right to add, remove or modify a reserve price on an item(s) at any time up until the end of the auction. c) Spokane Auctions LLC reserves the right to refuse bids from any individual. Successful bidders are required to pay a Buyer's Premium on each item purchased. The Buyer's Premium is 15% unless otherwise stated (There is a 3% discount if you pay with cash). Condition of Items: a) All items are sold "as is", where is. Bidders can come into the showroom and inspect all items on auction during business hours. For inspection of offsite items, you must make a prior appointment for inspections. All Offsite Auctions will have special preview days allocated for that auction. b) We make no representations and/or warranties with respect to the items in our auctions. We recommend that you visit our showroom or the auction specific site during the posted preview dates and times to inspect any items BEFORE bidding on any item. Some items will be sold with a 3-day guarantee from close of bidding. This guarantee will be posted if applicable in the items description as "This item is guaranteed for 3 days from bidding closure". Any items that are guaranteed must be picked up and if a problem has occurred, they must be returned within 3 days of bidding closure to qualify for a refund, or the sale becomes final. The guarantee only covers the working portion of the item, it does not cover any cosmetic and/or other flaws the item may or may not have. c) No price reduction will be allowed on any items, as all goods are being exposed for public exhibition and are sold "as is" and without recourse. d) Item Titles and Descriptions are provided to HELP identify an item. Titles & Descriptions are not complete and/or exhaustive. If a title or description says or states the item is "New" the item may be: New, or new opened box, new old stock, or new never used. The orders of conditions Spokane Auctions LLC commonly uses to help describe items are as follows: New, Like New or Mint, Excellent, Very Good, Good, Fair, Poor, and Parts. But descriptions and opinions can vary by individual people, so it is solely the bidder's responsibility to determine the actual condition of the item BEFORE they submit a bid. Spokane Auctions LLC cannot be held responsible for the actual condition of any item, or to the verbiage used in an items description by any personnel of Spokane Auctions LLC. e) Bidders can call us @ 509-703-7963 prior to close of an auction to get information on item(s) they are considering on bidding on. Responsibility and Ownership: a) Every item purchased becomes the responsibility of the new owner as soon as the bidding of online auction is concluded. If you are the highest bidder, you are responsible for insuring your purchase immediately. All buyers must be prepared to pack with their own packing supplies and boxes, and load their own items. We may be able to assist, but cannot guarantee staff will be available to assist. b) It is the sole responsibility of the Winning Bidder / Buyer to initiate contact with Spokane Auctions LLC with any requests to any purchases, including the shipping of any item(s). c) All items must be picked up or asked to be shipped via email within 4 days of the bidding closure, unless prior arrangements are made with Spokane Auctions LLC. Any items not picked up OR being shipped by the end of the 4th day of bidding closure will be considered abandoned and forfeited on the 5th day, and the item(s) then becomes the sole property of Spokane Auctions LLC. If the item(s) were abandoned, the Winning Bidder/Buyer still agrees to pay the full amount of the invoice plus any fees and all collection costs for nonpayment or refusal to pay on the abandoned item. Any abandoned item(s) can be re-auctioned by Spokane Auctions LLC and/or donated to a local charity of Spokane Auctions LLC choice. Absolutely NO Refunds or proceeds of re-auctioned item(s) will be given on any abandoned items. d) If prior arrangements were made with Spokane Auctions LLC for storing an item(s) after 4 days of bidding closure, there will be a Storage Fee of $1 to $5 per item, per day cost added to the winning bidders invoice. The cost of storing an item(s) depends on size and storage location for the item(s). Payment: a) Purchases must be paid in full before any item(s) can be picked up. Any Cash Deposit made by Absentee and/or Live Bidder will be applied to the final payment due for item(s) won, and the remaining amount due MUST be paid in full within 4 days following the bidding closure or the Cash Deposit will be forfeited. Absolutely NO Refunds will be given for the winning bidder cash deposits. b) All local invoiced customers must notify Spokane Auctions via email within 24 hours of the close of bidding if they wish to pay cash for their item(s) or the card on file will be billed after the 24 hour period has lapsed. ALL out of town invoiced customers will be billed immediately following the end of the auction bidding for the invoice ONLY unless they have notified Spokane Auctions via email prior to the close of the bidding. ALL Out of town invoiced customers will be billed for the Shipping separately upon Spokane Auctions preparing the shipments. c) Resellers must submit a Washington State Resellers permit before the conclusion of the auction. Failure to do so will result in sales tax being charged. This permit can be found at: https://dor.wa.gov/find-taxes-rates/retail-sales-tax/reseller-permits. d) The Buyer specifically waves the right to dispute and/or deny payment for any purchases made with a check, credit or debit card. e) The Buyer agrees to pay a $35 fee plus any and all collection costs incurred to Spokane Auctions LLC for any payment returned or denied for any reason. Pines RD Suite 8N Spokane Valley, WA. 99206 ONLY on the scheduled auction pick up days during the posted pick up hours unless prior arrangements were made. c) All items must be picked up within 4 days following the close of the auction bidding, unless prior arrangements have been made, with "NO EXCEPTIONS" or they will be abandoned per "Responsibility and Ownership" Sections c) and d) d) If the winning bidder is having somebody else picking up their items for them, Spokane Auctions REQUIRES the winning bidder to respond to the invoice received with "The Persons Full Name" of who will be picking up the item(s) for them. ABSOLUTELY NO ITEMS WILL BE GIVEN TO UNAUTHORIZED PEOPLE! e) SHIPPING IS NOT AUTOMATIC! Any winning buyer that wants their item(s) shipped must respond VIA email to the invoice and ask for their items to be shipped. Items being Shipped are NOT subject to the 4 day pick up time frame. Items being shipped will only be abandoned if the shipping payment was denied and there was no response to our phone calls or emails for a period of 5 days following the attempt to process the payment card on file for the shipping. f) Some items cannot be shipped. Some examples of these Items are: Furniture, Large Bulky Items, Heavy Items, Hazardous items such as, Alcohol, Gun Powder, Primers, Chemicals, Pressurized cylinders, or similar items. These types of items are local pickup only. You must contact Spokane Auctions LLC @ 509-703-7963 to determine if the item you are considering can be shipped BEFORE you bid. g) ALL Shipping fees and package costs are an extra cost to the winning bidder. The cost of the shipping cannot be cause to rescind the sale - please inquire about shipping costs prior to the close of the auction. Spokane Auctions will ship the items within 10 business days after the paid invoice. We have accounts with all major shipping carriers to give the best possible price on shipping to our customers, but because of people expecting us to ship LARGE LOTS / shipments of glass etc. and fragile items we now charge a flat rate of $30 per hour for packaging time for all shipments to cover our costs of labor for packaging. h) Spokane Auctions LLC only ships item(s) to U.S. addresses via USPS, FedEx or UPS. Canadian Bidders must provide a US Mailing Address or Pick up in person, NO EXCEPTIONS! i) Spokane Auctions is NOT be responsible for damage to items from shipping, so if you want your item insured, the winning bidder MUST ask for the shipping insurance. j) Items that will be shipped VIA FedEx or UPS, A physical address and phone number will be required. Spokane Auctions LLC will ship items in boxes that we have available, but some items may require special packaging and/or boxes. The winning bidder is responsible for paying all of these costs. k) Shipping of Small Arms Ammunition (50 Cal and Smaller In boxes not weighing more than 50 Lbs each) is by UPS or FedEx and a physical address will be required. Firearms: a) All firearms auctioned by Spokane Auctions LLC will be available for preview during specific preview days. b) There is a $30.00 firearm "Transfer Fee" that will be added to the winning bid for each firearm the winning bidder purchased. The Transfer Fee is for "Final Processing" of Washington State and Federal firearms paperwork through the registered Firearms Dealer of "Firearms Finishing Inc." and using the National Instant Criminal Background Check System (NICS). c) All firearms auctioned by Spokane Auctions LLC will be available for the winning bidder to begin the final processing paperwork 24 hours after full payment is made. Final processing of all firearms will be conducted at "Firearms Finishing Inc." during their regular business hours. Firearms Finishing Inc. is located at: 2420 E Trent Ave, Spokane, WA 99202 Phone Number: (509) 487-4145. Absolutely NO firearms can be picked up at any of Spokane Auctions LLC locations even if the winning bidder has a Federal Firearms license (FFL). d) All bidders of any firearms auctioned by Spokane Auctions LLC must abide by all Washington State and Federal Laws and Regulations regarding Firearm purchases, and be able to pass all state and federal NICS back ground checks for firearms. e) Winning bidders who do not pass the NICS background check, will be charged a $100.00 "Forfeiture Fee" for each firearm they are the winning bidder on, and the total high bid Buyer's Premium will also still apply. The Forfeiture Fee, Transfer Fee, and Buyer's Premium will not be refunded. f) Yes Shipping of firearms is available: It is the buyer's responsibility to arrange shipping of all firearms with Firearms Finishing Inc. and their FFL Dealer" and prepay for all shipping costs BEFORE the firearm will be shipped. All firearms will be shipped to a Federal Firearms License Dealer (FFL) holder only. By Submitting a bid signifies your agreement to these terms and conditions and by bidding you agree to hold harmless Spokane Auctions LLC of any liability for any item(s) you have purchased. If you do not agree to or understand any of these Terms and Conditions, DO NOT BID. DISPUTE RESOLUTION BY ARBITRATION and CHOICE OF LAW All disputes arising out of or relating to this Agreement, including, but not limited to, conduct and representations made during this Agreement's formation and negotiation, and based on any legal theory (including but not limited to contract, warranty, tort and fraud) will be resolved solely through binding and confidential arbitration in Spokane County, Washington by a single arbitrator, under the International Institute for Conflict Prevention & Resolution Rules for Non-Administered Arbitration then in effect. The arbitrator may issue temporary, preliminary, or permanent injunctive or declaratory relief, but may not award punitive damages. Any issue concerning the extent to which a dispute is subject to arbitration, shall be governed by the Federal Arbitration Act and resolved by the arbitrator. Nothing in this Section will prevent Spokane Auctions LLC from resorting directly to judicial proceedings for injunctive relief, if Spokane Auctions LLC deems a lawsuit necessary to prevent irreparable injury to Spokane Auctions LLC or to protect its intellectual property rights. The parties consent to the jurisdiction of state and federal courts sitting in Spokane County, Washington, for such judicial injunctive relief, and for enforcement of any judgment or arbitration award. The arbitration decision shall also remain confidential, except to the extent necessary to enforce the award in a judicial action. The parties waive any right to a trial by jury. This Agreement, including, but not limited to, its formation, execution and interpretation, shall be governed by Washington law, without regard to its conflicts of laws rules.

For a cash bidder, a Cash Deposit of 50% of the bid is required to for the bid to be accepted for any item(s). If none of the item(s) were won by the bidder, the cash deposit will be immediately returned to the bidder on the following day of the auction bidding closure. If any of the item(s) were won by the bidder, the cash deposit will be applied to the winning bidders invoice. d) Spokane Auctions reserves the right to extend the auction end date or time for any reason. e) There is a $5.00 Minimum Invoice Purchase if you are paying with any type of Payment Card, so if you win items under that total under $5.00, a "Minimum Invoice Fee" will be added to raise the invoice total to $5.00 Bidding: a) All bids submitted are final and irrevocable, whether they are submitted in person, online or by proxy. If you are the highest bidder, you are the new owner (Buyer) of that item and are under contract to fulfill and finish the sale. All sales are final. b) Most items are sold without reserve prices, but Spokane Auctions LLC reserves the right to add, remove or modify a reserve price on an item(s) at any time up until the end of the auction. c) Spokane Auctions LLC reserves the right to refuse bids from any individual. Successful bidders are required to pay a Buyer's Premium on each item purchased. The Buyer's Premium is 15% unless otherwise stated (There is a 3% discount if you pay with cash). Condition of Items: a) All items are sold "as is", where is. Bidders can come into the showroom and inspect all items on auction during business hours. For inspection of offsite items, you must make a prior appointment for inspections. All Offsite Auctions will have special preview days allocated for that auction. b) We make no representations and/or warranties with respect to the items in our auctions. We recommend that you visit our showroom or the auction specific site during the posted preview dates and times to inspect any items BEFORE bidding on any item. Some items will be sold with a 3-day guarantee from close of bidding. This guarantee will be posted if applicable in the items description as "This item is guaranteed for 3 days from bidding closure". Any items that are guaranteed must be picked up and if a problem has occurred, they must be returned within 3 days of bidding closure to qualify for a refund, or the sale becomes final. The guarantee only covers the working portion of the item, it does not cover any cosmetic and/or other flaws the item may or may not have. c) No price reduction will be allowed on any items, as all goods are being exposed for public exhibition and are sold "as is" and without recourse. d) Item Titles and Descriptions are provided to HELP identify an item. Titles & Descriptions are not complete and/or exhaustive. If a title or description says or states the item is "New" the item may be: New, or new opened box, new old stock, or new never used. The orders of conditions Spokane Auctions LLC commonly uses to help describe items are as follows: New, Like New or Mint, Excellent, Very Good, Good, Fair, Poor, and Parts. But descriptions and opinions can vary by individual people, so it is solely the bidder's responsibility to determine the actual condition of the item BEFORE they submit a bid. Spokane Auctions LLC cannot be held responsible for the actual condition of any item, or to the verbiage used in an items description by any personnel of Spokane Auctions LLC. e) Bidders can call us @ 509-703-7963 prior to close of an auction to get information on item(s) they are considering on bidding on. Responsibility and Ownership: a) Every item purchased becomes the responsibility of the new owner as soon as the bidding of online auction is concluded. If you are the highest bidder, you are responsible for insuring your purchase immediately. All buyers must be prepared to pack with their own packing supplies and boxes, and load their own items. We may be able to assist, but cannot guarantee staff will be available to assist. b) It is the sole responsibility of the Winning Bidder / Buyer to initiate contact with Spokane Auctions LLC with any requests to any purchases, including the shipping of any item(s). c) All items must be picked up or asked to be shipped via email within 4 days of the bidding closure, unless prior arrangements are made with Spokane Auctions LLC. Any items not picked up OR being shipped by the end of the 4th day of bidding closure will be considered abandoned and forfeited on the 5th day, and the item(s) then becomes the sole property of Spokane Auctions LLC. If the item(s) were abandoned, the Winning Bidder/Buyer still agrees to pay the full amount of the invoice plus any fees and all collection costs for nonpayment or refusal to pay on the abandoned item. Any abandoned item(s) can be re-auctioned by Spokane Auctions LLC and/or donated to a local charity of Spokane Auctions LLC choice. Absolutely NO Refunds or proceeds of re-auctioned item(s) will be given on any abandoned items. d) If prior arrangements were made with Spokane Auctions LLC for storing an item(s) after 4 days of bidding closure, there will be a Storage Fee of $1 to $5 per item, per day cost added to the winning bidders invoice. The cost of storing an item(s) depends on size and storage location for the item(s). Payment: a) Purchases must be paid in full before any item(s) can be picked up. Any Cash Deposit made by Absentee and/or Live Bidder will be applied to the final payment due for item(s) won, and the remaining amount due MUST be paid in full within 4 days following the bidding closure or the Cash Deposit will be forfeited. Absolutely NO Refunds will be given for the winning bidder cash deposits. b) All local invoiced customers must notify Spokane Auctions via email within 24 hours of the close of bidding if they wish to pay cash for their item(s) or the card on file will be billed after the 24 hour period has lapsed. ALL out of town invoiced customers will be billed immediately following the end of the auction bidding for the invoice ONLY unless they have notified Spokane Auctions via email prior to the close of the bidding. ALL Out of town invoiced customers will be billed for the Shipping separately upon Spokane Auctions preparing the shipments. c) Resellers must submit a Washington State Resellers permit before the conclusion of the auction. Failure to do so will result in sales tax being charged.
