There is a 10% buyer's premium effecting this sale. Also, there is a 3.5% convience fee for any credit card purchases. We do not automatically run the credit cards so you have the option to pay cash or check at pick up.
There will be no refunds so please come inspect these items during inspection hours. The items sold here are available for inspection at our location on a set day and time put forth in that auction sales.
You are strongly encouraged to inspect the items for description accuracy and condition prior to bidding. We do our best to describe every item as accurately and honest as possible but even we may over look something occasionally so we encourage you to please inspect the item prior to bidding.

Any bidder that has won a item has entered into a binding contract with the Hayes Group Auction and the seller of the item. The agreement of these terms and conditions are a binding contract. Unless there is due reason either by the seller or buyer to void the contract, nonpayment will be grounds to ban you from bidding on future auctions conducted by The Hayes Group Auction.

Bidding on our Online Auction site:
Bidding is done online and you must monitor your bid to see where you stand during the auction start and end time frame. You can enter a max bid and the system will bid for you up to your max bid but will not bid over the amount you have input so at the end of the auction you should be online or increase your max bid when outbid or enter a new max bid. You, as a bidder, understand and agree to how the maximum bid feature works if you choose to use it. You may or may not automatically receive notification if another bidder outbids your maximum bid so it's up to you to keep up with the bid on the items you have bid on. Your internet conection is the most important thing if you plan on placing bids at the last moment and Hayes Group Online Auctions cannot be held liable for you missing a bid due to internet issues on your part or ours so don't wait to bid! The owner/seller of property sold through Hayes Group Online Auctions reserves the right to reject any and all bids unless auction is advertised absolute or without reserve.
As a bidder:
By agreeing to the terms and placing a bid you are entering a binding contract. You are responsible for any bids placed by you or a designated representative under your bidding number and password. The security of your bidder information is your sole responsibility and the bidder will be responsible for any and all bids placed under the assigned number. If, at any time, you feel that your bidder number and password have been compromised, due to lack of security on your part, you must notify us immediately. Auctioneer is the one and only judge regarding the determination of winning bidders, and the single deciding authority if disputes should arise, and accepts no liability for any errors or omissions. Hayes Group Online Auctions reserves the right to reopen bidding on any disputed bids. Despite efforts to avoid the withdrawal of lots from the online auction sale after they are listed, it may sometimes be necessary to withdraw lots, therefore, the owner/seller reserves the right to do so at any time before or during the online auction sale.
Bid Retractions: There are no bid retractions. ALL BIDS ARE NON-CANCELLABLE ONCE SUBMITTED. Once a bid is made and confirmed, it cannot be retracted. When a bid is made you manifest your intent and ability to buy the lot at the bid price. A false or fraudulent bid may result in legal action. Any winning bidder who refuses to purchase the lot may be banned from all future online auctions.
Reserve Price: An auction lot may have a reserve price. The reserve price is the lowest price at which the lot will be sold. The reserve price is never disclosed to bidders, but a note may be displayed in the lot information screen specifying a reserve price. When the reserve price has been met the screen may read "reserve price met". The lot will then be sold to the highest bidder at the conclusion of the online auction sale. When an article is sold with reserve the auctioneer may bid on the owner/seller's behalf in an amount not to exceed the reserve price. If the reserve price is not met, the lot will not be sold during that online auction. The owner/seller reserves the right to accept or reject any or all bids unless otherwise stated.
Winning Bidder: The high bidder at the end of the allotted bidding time for each lot is the owner of that said item. All risk of damage, or injury/ death of livestock to each lot becomes the buyer's risk upon the end of the allotted bidding time. Each buyer, following his or her purchase, will receive an acknowledgement of purchase via e-mail outlining the details of the transaction including payment, settlement, and final terms.
Payment of won item: Acceptable forms of payment are Visa, Mastercard, Discover and American Express. Buyer shall be responsible for making arrangements for delivery of merchandise or shipping of merchandise. All bids are in US Dollars; all settlements will be paid in US Dollars. If you plan to pay by cash or check you must notify Hayes Group Online Auctions before the conclusion of the auction.
Pickup or transportation of won item: The buyer, Item(s) won via auction must be picked up as outlined in this auction or is considered abandoned and becomes property of Hayes Group Online Auctions to do with as they please. At buyer's own expense, shall transport the merchandise from the owner/seller. Specific arrangements will be indicated on each individual auction and expenses will be handled between buyer and owner/seller if not Hayes Group Online Auctions. If you have questions regarding transportation, contact Hayes Group Online Auctions before placing any bids.
Limit of Liability: In no event shall the auctioneer be liable for lost profits or any special, incidental, or consequential damages whatsoever arising out of or in connection with any sale or transaction. Hayes Group Online Auctions reserves the right to postpone or cancel a sale without notice, if it is determined that such action is appropriate, for whatever reason, is in our sole discretion. Hayes Group Online Auctions or our agents will neither have liability nor obligation to the intended bidders as a result of any withdrawal, cancellation, or postponement of any sale.
