Reasons we may consider rejecting your registration include but are not limited to: non payment history, low HiBid score, unsatisfactory behavior notes from other auction companies(such as past abusive behavior) etc -As a bidder you agree it is your responsibility to look at all photos provided and view auctioneer notes in the lot descriptions in their entirety. -You agree to hold auctioneers harmless if you fail to look at photos and information provided to you in auction lots. FORMS OF PAYMENT: -We do not accept cash. REASON: high volume of no show bidders to pick up. Therefore, our auctioneers have deemed cash acceptance a risk. We keep our consignors and our business financial interests in mind at all times.. -We do not accept checks -We accept cards -If you leave us notes instructing us not to charge your card and that you'll pay in cash, you will receive correspondence from us reminding you of these terms you agreed to. You also agree if you place a bid and win that lot item, we will still charge your card on file regardless of bidder notation requesting us not to. If you further contest this policy, even after we have politely reminded you of your bidder contract, we will not allow you to bid in our auction. -Bidder agrees their card will be charged IN FULL at the time of auction clerking.. TAXES: -We collect NC sales tax on sales as required by law if you reside in state. -Tax exempt bidders MUST present tax exemption certificate to auction company PRIOR to the clerking of an auction to be kept on file -We do not allow usage of a tax ID number alone. No copy of certificate=no exemption. -Bidder agrees that our company will not grant tax exemption once an auction is clerked at the close of an auction -Bidder agrees that if auctioneers notice tax exemption requests with questionable presentation, we may contact the department of revenue with your information for guidance and/or verification of tax exempt status - The NC Department of Revenue has stated to us that your tax exemption certificate must be on file with our company in order for you to receive exemption -The NC Department of Revenue stated to us that bidders are to contact them directly if they have tax questions/objections CONDITION OF ITEMS/WARRANTIES: -Bidder agrees above all else it is BIDDER RESPONSIBILITY to preview all items -Bidder agrees there are no warranties or guarantees of any kind expressed or implied -You as a bidder are fully responsible for asking any prior questions and/or previewing items -You agree as a bidder that auctioneer will not make any guarantees of any kind over the phone, email, etc. In person preview is 100% the standard for you to inspect items. -Bidder agrees that auctioneer tries their VERY BEST to make notation of chips, cracks, color loss, wear, tear, etc, but it is still 100% YOUR RESPONSIBILITY to use your best judgement prior to placing a bid -As a bidder, you agree to hold auctioneers harmless over condition upon receipt of won items -As a general rule for this auction: most furniture pieces have some degree of wear. As a bidder you agree that it is your responsibility to attend preview. If you do not attend preview, you as a bidder accept and agree you have chosen not to inspect items prior to bidding. NON PAYMENT: -If you card does not go through upon clerking of the auction, it is your responsibility to fix your payment -If you do not pay your bill in full before the end of the last designated pick up day, you will forfeit your items, and we will resell that item(s). We will mark your HiBid account with non payment notations for other auction companies -If you show up to pick up with forms of payment other than a card, you will not receive your won items until you present a valid card that goes through. -Non paying bidders are permanently banned from bidding in our future auctions with no second chance if bidder does not resolve -If you do not pay your bill, you agree you will also run the risk of being turned over to collections and/or be subject to having legal action taken against you. -You agree as a bidder if you initiate a credit card chargeback at any point after the close of an auction, you run a strong risk of us taking legal action against you. FACILITY ENTRY WAIVER: -You agree by either entering a bid and/or signing this waiver physically, you have agreed to this waiver -You agree as a bidder, both Gander & Gavel Auction Co. LLC and our client Renu Life are not responsible for accident, illness, injury, or death while bidder is on the premises before, during, and/or after any preview of auction items and during auction pick up. -You agree as a bidder to be your own advocate for your health and safety (ie: face mask, safety gear, goggles, respirator, etc) while on the premises and you agree Gander & Gavel Auction Co. LLC and our client, Renu Life, are not responsible. -You agree as a bidder Gander & Gavel Auction Co. LLC and our client Renu Life are not responsible for damage to your auction winnings as they are being removed from the premises. -You as a bidder hereby agree to hold Gander & Gavel Auction Co. LLC and our client Renu Life free of legal harm from any and all possible accident, injury, damage to your auction winnings, death, and/or illness that may occur before, during, and/or after you are on the premises. -You agree as a bidder to be responsible for your own items at pick up and Gander & Gavel Auction Co. LLC and our client Renu Life are not responsible for theft of unattended auction winnings. No refund will be granted in the event theft occurs. REMOVAL OF FIXTURES AND/OR ITEMS: -You agree as a bidder to provide your own tools in the event you win auction lot(s) that will require removal from walls, etc -You agree as a bidder that Gander & Gavel Auction Co. LLC will not have these items removed for you ahead of pick up day -You agree as a bidder that Gander & Gavel Auction Co. LLC auctioneers and staff will not assist bidder in removal of fixtures on pick up day -You agree as a bidder that you will provide your own help for removal/disconnection of industrial/commercial equipment, heavy and large furniture, etc -You agree as a bidder that Gander & Gavel Auction Co. LLC auctioneers and staff will not be able to help you move, lift, or load auction winnings at pick up. You agree this is not negotiable -You agree as a bidder that Gander & Gavel Auction Co. LLC does not provide equipment for removal of items such as hand trucks, tools, straps, etc. This list is included but not limited to. PICK UP POLICIES: -Any and all items left after 5 PM on Saturday October 30th, 2021 are automatically deemed abandoned and bidder will forfeit those items with no refund granted. Bidder agrees to this upon registration and agrees to hold auction company harmless in the event bidder loses their items due to choosing not to pick up their items on time. -We will not have boxes and packing materials available. You agree this is solely your responsibility -We are unable to help you move, lift, disconnect, and/or load items at pick up. Please show up prepared and with your own manpower. -We don't offer delivery services at this time -We will resell/dispose of your items how we see fit if you do not show up to pick up to retreive your items by the close of the last pick up day. -We do not offer early pick up. If you show up early to pick up time, the door will REMAIN closed and locked until the scheduled open hour. -We do not open the facility at anytime under any circumstances outside of our schedule and/or appointment log. -You agree you will be required to sign in and out of the facility. -You agree you will be required to place a signature on a copy of your invoice and a copy of your terms and conditions at pick up. -In the event there is inclement weather or special circumstances (ie: icy conditions, gasoline shortages, impending hurricane conditions) we will contact all bidders personally and grant alternate pick up dates/times. -Understand, our time is just as valuable and important as yours and we also have family time outside of our business hours. If you cannot make the designated pick up times, or you forget to show up, we won't be able to help you. You will forfeit your items if you don't show up. We do give the courtesy of sending reminders to bidders before pick up days close out to give you a chance in case you forget. We also send an information email reminding of pick up to all bidders at the close of an auction. Simply send someone to retreive your items, or do not bid if you won't show up. AUCTION CLOSING TIME: -As a bidder you agree that auction closing time is a very busy time -You agree that there is a strong chance auctioneers may not see your texts/emails in time if you send them at the last minute with inquiries (on auction closing day) -You agree to hold auctioneers harmless if you wait until the last day to contact us and we do not see your concerns in time. -You agree that we may or may not be on our premises during auction closing time and therefore may not be able to answer your questions regarding specific items on auction closing day.
