All items offered for sale at the Auction ("Items", "Property", "Product", "Purchases") are subject to the following Terms and Conditions of Sale, which, combined with each Auction's specific terms as posted in materials and on the web, make up the Complete Terms and Conditions of Sale. "AS IS, WHERE IS": All vehicles and their contents will be sold "AS IS, WHERE IS," with no warranties, expressed or implied, including, but not limited to the warranty of merchantability. Buyer agrees that vehicles are purchased "With All Faults." The bidder is responsible for inspecting vehicles prior to bidding. The auctioneer makes the final decision regarding the winning bidder on each vehicle. All sales are final. NO REFUNDS. NO CREDIT CARD CHARGEBACKS. Errors and Omissions: Dudley's Auction Company is not responsible for printed errors or omissions in regard to year, make, model or mileage of vehicles or any other defect in the title or registration paperwork. Auctioneer shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. On-site inspection of items being sold is recommended. Auctioneer makes every effort to provide accurate information about the items being sold. However, neither Auctioneer nor its Client will assume responsibility for Buyer's bidding errors. It is Buyers' full responsibility to confirm the accuracy of items offered for sale. Buyers are recommended to inspect all items. Descriptions and photos are offered as a guide only. Do not rely solely on photos to make buying decisions, be sure to read descriptions. Auctioneer shall not be held responsible for such errors as posting the wrong photo for an item. Dudley's Auction Company makes every effort to accurately represent the vehicles which are advertised online. When in doubt about the condition of an item, please bid accordingly. Buyer responsibilities: The buyer must register the vehicle with the state Motor Vehicle Department after purchasing it. Buyer assumes full responsibility for transfer and ownership. Buyer is responsible for all DMV and Emission Fees. All emission related repairs are the responsibility of the buyer. Registration: All Bidders are required to be at least 18 years of age, have a valid government issued ID and a valid Debit/Credit card which will be validated at time of registration . The bidder's number is nontransferable. All bids made using the bid number will be the responsibility of the Buyer. Changes to items offered for sale: Dudley's Auction Company reserves the right to sell any vehicle prior to auction start and may also add, delete or modify vehicle information prior to close of sale. Auctioneer's Refusal of Bids: Dudley's Auction Company reserves the right to accept or reject any and all bids submissions. If a dispute should arise among two or more bidders, the decision of Dudley's Auction Company shall become final and absolute. Preview of Items: Preview inspections are welcomed and recommended, but vehicles may not be removed from premises. Preview of items will be allowed only on the date/time set by Dudley's Auction Company. Those found tampering with vehicles or inspecting without Auction Firm's authorization will be asked to leave the premises and may be subject to prosecution. Preview Date: You may preview all of the items for this auction on Saturday November 10, 2018 from 1:00 pm - 3:00 PM EST. Payment: Upon becoming a successful bidder at the conclusion of the auction, please contact us to confirm if payment will be made by the Credit /Debit card on file or payment will be made upon pickup. Forms of payment accepted are Visa/ MC/Discover/ AMEX. Cash or valid cashier's checks may be accepted at auction company's discretion. All items must be paid in full no later than 6:00 pm on Thursday 11/15/18 or the card on file will be automatically charged for the price you bid plus applicable fees. BUYER'S PREMIUM: A 19% buyer's premium will be added to each purchase paid by card. A 16% buyer's premium will be added to each purchase paid by cash of cashier's check. Pickup: All successful bidders are responsible for any and all costs for shipping the vehicle from sale location to destination. All sold vehicles will be available for pickup on the next business day following close of auction. Vehicles paid in full by card or cash must be removed from premises within five (5) business days following auction close. Vehicles paid by valid cashier's check will not be available for pickup and title will not be released until ten (10) business days after close of auction. Pickup hours for payments by card or cash: Thursday November 15, 2018 10:00 am - 6:00 pm EST. Friday November 16, 2018 10:00 am - 1:00 pm EST. Failure to Remove Purchases: No refunds will be given for vehicles not removed within said timeframe. In the event items are not removed within five (5) business days (or 10 business days for cashier's check payments) after the auction's end, the items purchased shall be deemed abandoned and Buyer will lose any right, title or interest Buyer may have acquired and the items shall revert and repossess to Auctioneer without further notice to Buyer. Auctioneer shall also be entitled to any costs associated with the removal, storage and reselling of Buyer's items, and any other charges, fees, and expenses incurred as a result of Buyer's failure, including all attorney fees and costs incurred by Auctioneer to enforce Buyer's obligations hereunder.
