By bidding with our auction company, you are agreeing to the following.
-All sales are final. Everything is sold "AS IS" with no guarantees unless otherwise stated by the auctioneer. It is the responsibility of the bidder to assure him or herself as to the condition of items prior to bidding. Condition reports given by the staff of Bontrager's Auction Service are subjective, and while we strive to be honest, we will not be held responsible or liable for any errors in description. Buyer is responsible for examining items before bidding. Auction company does not take responsibility for buyer's failure to examine. Merchandise is not subject to adjustments once the item has been sold.
-Bontrager Real Estate & Auction Service and its staff will not be held responsible or liable for any errors in absentee/left bids or phone bids, nor for the possible failure to execute left bids for any reason.
-Payment is due in full within the time limits posted in the auction. For this auction, all payment will be made through the credit card you provide when you register. We accept Visa, MasterCard or Discover. (Please note that while you may be able to register for our auction with any credit card, we will only accept Visa, MasterCard, or Discover for payment.) 13% buyer's premium and NYS sales tax added to all items purchased. Late payment will result in a $25 late fee.
-Charges will range from $10 - $25 depending when auction purchases are not picked up on the designated pick up date, even if you are consolidating pick ups for multiple auction purchases. Charges will vary depending on location (many items are not at our auction center), size, fragility, and length of storage time.
-By bidding with our auction you are entering into a contract with our terms and conditions. You are accepting responsibility to perform your duties as winning bidder, and agreeing that Bontrager Real Estate & Auction Service, its employees, officers, owners, representatives, agents, and consignors will not be held liable for any losses, claims, liabilities, judgments, expenses, fees, or other damages arising from the use of our services, website, auction property, and this site, including property damage, injuries, dispute with another bidder, or breach by bidder of this site. Any liability to a purchaser will not exceed the purchase price actually paid.
-Successful bidders will sign their receipt at the time of merchandise pick up indicating that all items are present and in satisfactory condition. No returns, refunds or exchanges will be issued after the merchandise leaves the pick up location.
-Bontrager Real Estate & Auction Service will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
-Bontrager Real Estate & Auction Service has the right to void any sale, suspend bidding, re-sell any item/lots for any other reason.
-All sales are subject to appropriate sales tax and buyer's premium. Buyer's premium is 13% of purchase price and is subject to sales tax.
-Bids cannot be retracted once the auction begins.
-Buyers are responsible for making arrangement to pay for and pick up items within the time frames listed for the auction. Any variation, resulting in late pick up or payment will result in additional fees of $10 - $25, plus additional fees required for moving or storing the merchandise. There is no delivery service for this auction. Bontrager's Auction Service is not liable for any damage to property left on the auction premises after the auction, whether or not payment has been made. We reserve the right to impose a storage fee of $10 per month for property not picked up within stated deadlines. Merchandise left 1 month after the auction is subject to sale with the proceeds covering storage and auction fees due to the auction company.
-Buyers must contact the auction company prior to the close of auction to determine whether or not we will ship an item; we do not automatically agree to ship every lot. When it is agreed that we will ship, buyer pays shipping fees, handling charges (usually $10 - 25 depending on the size/weight/bulk of the package. The auction company will take fragile items to UPS for professional packaging (there is a $20 handling fee for this service.) Buyer pays duty and taxes for shipping outside the USA.
-In the event of legal proceedings arising from this contract or from the auction in connection therewith, buyer consents to being subject to the personal jurisdiction of the courts of the State of New York, Genesee County.
-For this auction, payment is by credit card only. There is one day only merchandise removal at the location listed.

Address in Alexander, NY will be emailed to successful bidders. There is only one pick up date for this auction so please plan accordingly.
SHIPPING:
No shipping for this auction. Local pick up only.
DELIVERY:
We do not offer delivery, however we recommend Reeb Family Moving, LLC. They can be contacted at at 585-813-9758 or 585-599-3563. We will work with you and them for a smooth removal.
PAYMENT: All payments will automatically be charged to the buyer's credit card.
MERCHANDISE PICKUP DATE: Friday, September 11th, 12 noon to 5 p.m. BY APPOINTMENT in Alexander, NY. The address will be shown to successful bidders when they confirm their appointment for pickup.
-If you are unable to pick up on the scheduled date, please send someone in your place or kindly refrain from bidding in this auction. We are unable to accomodate multiple dates for pickup.
-Customers will be assisted by appointment times for pickup. It will be necessary for customers to enter the building to to remove merchandise. Masks are required by NYS law, and number of people in the building will be limited. Customers should come prepared to remove the items themselves and bring any assistance or tools they may need.
-There is no delivery or removal to our auction center. If purchases are not picked up there will be a minimum $20 removal fee, plus storage fees.
PICK UP LOCATION: Different auctions may have different pick up locations, so pay close attention to the location for your auction. The specific location (in Alexander, NY) is disclosed to successful bidders when they make their pick up appointment. Not only will you see the location on your appointment confirmation page, but you'll be emailed a confirmation of your appointment time, with the address, and a link for directions.
