The terms of sale are non-negotiable. Registering to bid either live, online or absentee signifies your acceptance of the terms. Your bid is a binding agreement. Do not place a bid unless you intend to honor it. Bid Retraction will result in immediate suspension of all bidding privileges. Soft Close Auction: If a bid is received within the final 3 minutes, then time will be extended an additional 3 minutes. Inspection: Friday December 10th from 9am until 4pm and Saturday December 11th from 9am until 2pm. All inspections must be completed prior to bidding. General: 'AS IS, WHERE IS, WITH ALL FAULTS'. Terms: 10% deposit due within 48 hours of the auction's end, balance due at closing within 45 days of Court approval. Subject to Court approval. Not subject to financing. At closing, Seller to pay for deed preparation, prorated taxes, existing mortgage satisfaction, and all auctioneer's fees. At closing, Buyer to pay all other closing costs, including but not limited to recording fees, title policy (should Buyer desire), survey (should Buyer desire), inspections (should Buyer desire), closing agent or attorneys fee, etc. Seller will provide a free and clear deed to the property. Possession given at closing. All personal property remaining in the Property as of closing, if any, will become property of the Buyer. Sales Contract: The contract is required to be fully and correctly completed, without any modifications, properly signed and submitted to Heritage within 48 hours of the auction's end. Buyer's Premium: None on the real estate. Bidder/Buyer Default: High Bidder/Buyer not executing and returning the sales contract with deposit within 48 hours of the auction's end will be considered in default. In the event a high Bidder/Buyer fails to submit the signed sales contract and deposit, the high Bidder/Buyer shall pay to Heritage, as damages, an amount equal to the deposit, as set forth in said sales contract, and any and all expenses incurred by Heritage, for said auction. Should high Bidder/Buyer's deposit check be returned for any reason whatsoever, this shall constitute an item of default, and in addition to the remedies previously stated herein above, high Bidder/Buyer shall also pay an additional penalty of five percent (5%) of the deposit check to Heritage. High Bidder/Buyer shall also pay a reasonable attorney's fee and costs incurred in the collection of these monies owed by high Bidder/Buyer as a result of high Bidder/Buyer's default. High Bidder/Buyer shall also pay the Seller any damages caused by said breach of contract, including attorney's fees and costs. This shall not preclude the Seller from suing for specific performance of the sales contract, in addition to said damages. Any disputes will be tried in a court of jurisdiction in Houston County, Alabama. Heritage reserves the right to sell to the next highest qualified Bidder/Buyer in the event the successful high Bidder/Buyer does not comply with the terms of the sale. The contract is required to be fully and correctly completed, without any modifications and properly signed. A contract that is incomplete, incorrect, or modified in any respect, is considered to be in default. Broker Referral: a 2% referral fee will be paid to the winning Buyer's Agent at closing.
