The terms of sale are non-negotiable. Registering to bid either live, online or absentee signifies your acceptance of the terms. Your bid is a binding agreement. Bidder/Buyer Default: High Bidder/Buyer not executing and returning the sales contract with deposit within 48 hours of the auction's end will be considered in default. In the event a high Bidder/Buyer fails to submit the signed sales contract and deposit, the high Bidder/Buyer shall pay to Heritage, as damages, an amount equal to the deposit, as set forth in said sales contract, and any and all expenses incurred by Heritage, for said auction. Should high Bidder/Buyer's deposit check be returned for any reason whatsoever, this shall constitute an item of default, and in addition to the remedies previously stated herein above, high Bidder/Buyer shall also pay an additional penalty of five percent (5%) of the deposit check to Heritage. High Bidder/Buyer shall also pay a reasonable attorney's fee and costs incurred in the collection of these monies owed by high Bidder/Buyer as a result of high Bidder/Buyer's default.
