REAL ESTATE AUCTION TERMS AND CONDITION Registration: Auction registration will begin one hour prior to the beginning of the auction. All bidders are required to register with a valid form of photo ID (driver's license) and acknowledge having read and agree to be bound by the auction terms and conditions. Bidders are required to have a "bid card" prior to placing any bids at the auction. Onsite bidding will be allowed on individual tracts, combinations of tracts, and on the entire ranch. Online bidding will be allowed on the entire ranch ONLY. Bidders Proof of Funds: Bidders will be required to bring or submit before auction day a bank letter, proof of funds letter, letter of finance, or, Pre-approval letter WITH specify dollar amount. Buyer's Premium: A 6% buyer's premium shall be added to the high bid at the auction to arrive at the total contract price to be paid by the successful bidder(s) on any and all tracts sold. An additional 1% buyer's premium shall be applied to any successful online bid placed to arrive at the total contract price of the property. Down Payment and Contract Signing: The successful bidder(s) shall be required to place 10% of the total contract price in escrow and sign the purchase agreements, immediately following the conclusion of the auction. The down payment shall be in the form of (cash, cashier's check, personal check or business check). FAILURE TO CLOSE: In the event that the successful bidder fails to close for any reason that is not the fault of the Seller, the earnest money shall be retained by the Seller as liquidated damages and divided equally between the Seller and the Broker. Financing: Financing is not a contingency of the sale in this auction. Therefore, it is strongly recommended that all bidders arrange any financing needed to close the transaction prior to placing any bids at the auction. Closing: Closing shall take place on or by August 27, 2018. Possession shall be delivered to the buyer at closing. Title: Seller shall furnish at seller's expense an Owner's Policy of Title Insurance in the amount of the total purchase price. Title shall be transferred by General Warranty Deed. Survey: Seller shall furnish to buyer a copy of the current survey and field notes. However, if either buyer or buyers lender require a new survey, it shall be at buyer's sole expense. Taxes: The 2018 taxes shall be prorated to the date of closing. Property taxes (including rollback taxes) incurred after closing shall be the sole responsibility of the buyer. Agency: Platinum Auctions and its representatives are Exclusive Agents of the Seller. ENVIRONMENTAL DISCLAIMER: Seller, Brokers and Auctioneer do not warrant or covenant with Buyer with respect to the existence or nonexistence of any pollutants, contaminants, or hazardous waste prohibited by federal, state or local law or claims based thereon arising out of the actual or threatened discharge, release, disposal, seepage, migration or escape of such substances at, from or into the demised premises. Buyer is to rely upon his/her own environmental audit or examination of the premises. Buyer can perform inspection at there own cost before auctions day. CLOSING COSTS AND PRORATIONS: Seller shall pay all customary and usual closing costs paid by Sellers of Real Estate in Florence County, WI including title insurance premiums, excise tax, one-half of document preparation, one-half of escrow fees, and pro-ratable items. Purchaser shall pay all customary and usual closing costs paid by buyers of real estate in Florence, WI, including recording fees, one-half of document preparation, one-half of escrow fees, sales or use tax, if any, and pro-ratable items. Broker Participation: a (4%) buyer's broker fee shall be paid to any properly licensed broker that registers and represents a successful buyer at the auction, which is not already working with the auction company.
