TERMS AND CONDITIONS OF REAL ESTATE AUCTION 1. REGISTRATION: Bids will only be accepted by registered bidders. Registration begins online on September 18, 2017. 2. TERMS OF SALE: All property is sold "AS IS, WHERE IS" With all faults. Bidders should perform such independent investigation with respect to the property as they deem necessary and appropriate, ALL SALES ARE FINAL. 3. AGENCY: The auction company and its representatives represent the seller. 4. ANNOUNCEMENTS: Announcements day of sale take precedence over all prior communications, verbal and written concerning this sale. 5. BIDDING: The auctioneer will determine bid increments. 6. DEPOSIT ON REAL ESTATE: 10% of the purchase price shall be paid day of sale by Cash, Personal Check or Cashier's Check. 7. CLOSING DATE FOR REAL ESTATE: The balance of the purchase price is due at settlement within 30 days of auction end. 8. TRANSFER OF TITLE TO REAL ESTATE: The real estate will be conveyed by general warranty deed free and clear of liens subject, however to any recorded rights of way, easements, conditions and restrictions. 9. FINANCING: The sale of the real estate is a cash transaction and is not conditioned upon the bidder obtaining financing. Bidders should arrange any necessary financing prior to registration to bid. 10. BROCHURE: The information contained in the brochure is subject to independent verification by prospective bidders. Neither the Auction Company nor the Seller assumes any liability for its accuracy or any omissions. Boundaries contained in this brochure are approximate. 11. RESIDENTIAL REAL ESTATE ONLY: All real estate sold at this sale is RESIDENTIAL REAL ESTATE ONLY. TERMS: 10% of the total sale price down as a non refundable earnest money in the form of a certified check, or cash within 24 hours of auction close . We do not accept a credit card for down payment except in a default of the terms and conditions by buyer in which case the credit card will be debited for a $2500.00 non refundable administrative fee. The balance of purchase price is due at closing, said closing to be within 30 days of close of bidding. . Closing will be as specified in the Contract for Sale of Real Estate. PURCHASERS MAY, AND IT IS PREFERRED, THEY CLOSE ON OR BEFORE 30 DAYS OF CLOSE OF BIDDING.
