TERMS: Cash or check with a 10% Buyer’s Premium attached to all sales to determine final sale price. A 6% Sales Tax will be charged unless a Resale Certificate is presented with all items selling. All property offered in “AS IS” “WHERE IS” condition. It shall be the responsibility of all potential buyers to inspect prior to bidding and all bidders shall bid or buy based upon that inspection. All announcements made day of auction take precedence over all printed or oral information PAYMENT: Payment for purchases shall be cash, check or credit card with Government Issued Photo Identification, VISA, MASTERCARD, DISCOVER OR AMERICAN EXPRESS. All Credit Card purchases will incur a 3% upcharge. Full payment shall be made at the completion of the Online Auction. All checks must be made payable to Bolinger Real Estate & Auction. Buyer agrees NOT to stop payment for any reason on all check(s) given to Bolinger Real Estate & Auction for settlement of auction purchases as all sales are final. Bolingers WILL NOT accept drafts. Non-Sufficient Funds checks will be subject to a $100.00 Administrative Charge and prosecution where applicable. 10% BUYERS PREMIUM: All sales will be subject to a 10% buyer’s premium to help defray the cost of the auction. The bid price plus the buyer’s premium will equal the total contract sale price. WARRANTY: All items sold “As Is, Where Is!” The Auctioneer assumes no liability for any guarantee made by the seller. No warranty is made by the Auctioneer, either expressed or implied, as to the condition, merchantability, or fitness for intended use of any property sold. It is agreed that the buyers have thoroughly examined the property to be conveyed and relies solely upon his/her own judgment in making an agreement to purchase, and that there are no agreements, understandings or representations made either by seller, Auctioneer or Auctioneer’s representatives that are not set forth herein. REMOVAL DATE: All Items must be picked up NLT 3:00pm On Wednesday June 10, 2020. All Property must be removed from premises by the NLT date unless other arrangements are made with Bolingers Real Estate & Auction. SALES TAX, PURCHASES BY DEALER FOR RESALE, ETC.: All sales are subject to sales tax laws of the State of Kentucky. It will be necessary on sale day to execute a Certificate of Resale for all purchases to be resold. This certificate must bear your sales tax permit number. Failure to furnish this information will require payment of sales tax on all purchases. SHIPPING: Shipping is possible, and all shipping expenses will be the responsibility of the buyer. Bolinger Real Estate & Auction will assist in shipping items once all items and shipping expenses are paid for in full and method of payment has cleared. If you are wanting to have an item shipped, please notify us prior to completion of the auction. TRANSFER LOCATION FOR NON-LICENSEE’S: Before any firearm is transferred into your possession, you will have to fill out a 4473 and pass a background check. All background checks, transfers and related actions will have to be completed at Whisler’s Auction Building, 76 Skipworth Road, Lewisburg, Kentucky POSSESSION OF FIREARMS: You will not be able to take possession of the firearms until 4473 and background check have been completed and firearm is paid for in full. Qualified Firearms Dealers may take possession of firearms at the auction location if they provide the proper documentation, i.e. FFL, Business License, Resale Tax Certificate, etc. Possession of the firearms will not take place until your payment has cleared the bank. FELONS: If you are a convicted felon, even if you have had your right to vote restored, you may not be able to own or possess firearms. Please do not bid on these weapons unless you have been issued a possessory number by the BATF. SHOTGUNS & RIFLES: Must be at least 18 to bid on Shotguns and Rifles and Ammo. We can convey long guns to you in the State of Kentucky if you are from another state, provided that the long gun being conveyed is legal in the state where you reside. If you are out of State, your state laws apply. HANDGUNS: Must be at least 21 to bid on Handguns. If you are from a state other than the State of Kentucky, we cannot transfer a handgun to you. You will have to give us the name and contact information for a federal firearms licensee in your area, and we will transfer the handgun to the licensee and they will have to transfer it to you. That licensee may charge you an additional fee for that service. This does not apply to long guns. POSSESSION OF PURCHASED FIREARMS: You will not be given possession of firearms purchased until your payment has cleared the bank. If you pay cash, we can convey the weapon as soon as possible after you fill out the appropriate paperwork and pass the background check. RESIDENCE: If you are military personnel from another state and your permanent duty station is in the State of Kentucky, I can transfer the weapon to you with a copy of your orders stating that Kentucky is your permanent duty station along with Government Issued Photo Identification. CITIZENS/NON-CITIZENS: If you are not a citizen of the United States, it is incumbent upon you to be sure that you are in compliance with all federal requirements for firearms ownership prior to bidding on any firearms. BACKGROUND CHECK STATUS DENIED: If you purchase a weapon and are denied, you cannot bring someone else in to get a background check done. The background check is on the bidder only. If you are the successful high bidder and are denied on the background check, we reserve the right to place the firearm in the next available auction event and will resell it for you. You will be charged a 25% commission on the sale under these circumstances and if you make a profit, that’s your good luck.
