Reno, NV 89521, APN# 004-281-46, and more particularly and legally described as follows: LOT 194S-40S SE4NE4-S2/17N/21E, Storey County, Nevada. BIDDING OPENS & CLOSES: -Online Bidding Opens on Monday, June 17, 2019 at 7:00pm (PDT) -Online Bidding Closes on Tuesday, July 23, 2019 at 10:00am (PDT), subject to the "soft close" function (see description below) By signing below, I acknowledge that I have read and fully understand the Online Auction Bidders Agreement and the Terms and Conditions of this auction. I fully understand and agree that an Online Auction Bidders Agreement MUST be signed and returned to United Country - Capstone Realty, prior to being allowed to bid in the Online Auction. As a bidder, it is solely my responsibility to contact the auction company at (775)773-8725 with any questions regarding the auction, purchase agreement or terms & conditions, prior to placing any bids in said auction. Online Auction Terms & Conditions 1) This property is being sold with a reserve. Once the reserve has been met, the property will sell to the highest bidder. 2) There is a non-refundable 10% buyer's premium, which is due at AUCTION close. 10% will be added to your winning bid to arrive at the contract price. KEEP THIS IN MIND WHILE YOU'RE BIDDING. EXAMPLE: High bid $100,000.00 X 10% = $10,000.00. $100,000.00 + $10,000.00 = $110,000.00 is the contract price. 3) Bidding Registration: Online bidder hereby agrees that they must be properly registered for the online auction by completing and signing this (Online Auction Bidders Agreement), which will be sent by email via DocuSign. A Pre-Approval letter for financing or a Proof of Funds letter for Cash Sale from your financial institution shall also be emailed prior to bidding privileges being turned on. Upon completing this registration form and receiving approval, bidding privileges will be turned on. Each purchaser is responsible for obtaining his/her own financing if necessary. You must be pre-approved for financing and provide the pre-approval or proof of funds letter (for a cash sale) to the Realtor /Auctioneer in order to be approved to bid. If you are unsure of your ability to obtain the necessary financing, do not bid as you could lose your earnest deposit if you don't close. The seller is offering an Owner Carry Back/Seller Financing for the property as well. The Terms are as follows: 20% non-Refundable Down Payment due the day the auction closes, 7 Year Term and 0% Interest and 10% Buyer's Premium also due at AUCTION close. 5) If you wish to be a back-up bidder, please contact the auctioneer after the auction and we will put you on the list in the event the high bidder does not close. This is a matter of reference only. 6) Bidding Opens/Closes: The Online Only Auction (i.e. Internet Auction) bidding shall be opened and close on the dates and times stated above. 7) Property Preview Dates: The property can be previewed on Saturday, June 29th from 1:00pm to 4:00pm. Property inspections are the sole responsibility of the bidders. 8) No Financing Contingency: By participating in this auction, bidders hereby agree that their bid shall NOT be subject to the bidder's ability to obtain financing. Buyer may use financing to purchase property, but a Pre-approval letter from the financial institution must be provided to the AUCTIONEER prior to being approved to bid. By placing a bid in this auction, bidders are making a "cash offer" to purchase the property. Financing is NOT a contingency in the purchase and sale agreement. The contract is NOT assignable, nor is it contingent upon inspections. 9) Buyer's Premium: A non-refundable TEN PERCENT (10%) Buyer's Premium shall be added to the final bid price placed online, which will determine the Total Contract Sales Price. Bidders hereby understand that the Buyer's Premium shall be added to the winning bid to create the Total Contract Sales Price for which they are obligated to pay for the property. The non-refundable 10% Buyer's Premium is due at AUCTION close and will be rolled into the Earnest Money/Down Payment Deposit. 10) Purchase Contract: Winning bidder hereby agrees to enter into a Contract to Purchase the property immediately upon being declared the Successful Bidder by the Auctioneer. Upon the close of the auction the winning bidder will be forwarded via email an Auction Real Estate Sales Contract to purchase the property. A signed copy of the Auction Real Estate Sales Contract must be received by United Country - Capstone Realty no later than 24 hours from the time said Purchase Contract was sent to the winning bidder. The Auction Real Estate Sales Contract may be (hand delivered, faxed, or scanned and emailed). A sample purchase contract is available for review online prior to placing any bids in the auction. 11) Earnest Money/Down Payment Deposit: An Earnest Money/Down Payment deposit of TWENTY PERCENT (20%) of the total contract purchase price (which includes the 10% buyer's premium) for a Commercial financed or Cash sale or THIRTY PERCENT (30%) of the total contract purchase price (which includes the 10% buyer's premium) for a Seller financed sale shall be wire transferred or hand delivered in the form of certified funds to the Title Company no later than 24 hours following the close of auction. If the Buyer desires survey, it shall be at the Buyer's sole expense. 16) Possession: Possession of the property will be given upon payment in full of the purchase price and transfer of title at closing. 17) Title Insurance: Title Insurance in the full amount of the purchase price will be provided by the seller. Upon completing this registration form and receiving approval, bidding privileges will be turned on. If you are unsure of your ability to obtain the necessary financing, do not bid as you could lose your earnest deposit if you don't close. By placing a bid in this auction, bidders are making a "cash offer" to purchase the property. Financing is NOT a contingency in the purchase and sale agreement. The contract is NOT assignable, nor is it contingent upon inspections. 9) Buyer's Premium: A non-refundable TEN PERCENT (10%) Buyer's Premium shall be added to the final bid price placed online, which will determine the Total Contract Sales Price.
